Dilshad

Hi ,
I have been observing this forum for a long time and it has helped a lot with all the details given by u guys. Thanx a lot . My case was forwarded from florida and recieved by the atlanta DOL on july 1st 2003. I was very upset when the dates were updated to june 2004.and called my lawyer who in return gave me an answer saying my case was transferred to BRC.But yesterday when i went to meet her she gave me the good news that the atlanta dol has updated the dates and that there was a typo , therefore the dates are june 2003. All the cases from sept 23rd 2003 have been sent to BRC.therfore my case is still in atlanta. The atlanta dates have been updated back to june 2003. u guys can check the website to see the dates .
All the best to all of u

I didn't read any SWA word there...it is said Atlanta Labor Department in chinese. I only doubt it is PD or RD in Sep 2003.
find another chinese to read it again.

Confusion

My Lawayer also saying ATL DOL keep files up to Sept, 23, 2003, yesterday my HR called ATL DOL asked about Sept, She said from Sept 2003 (Including ??) all file moved to BEC!!

No, i dont have anymore chinese friend. She interpretted as atlanta labor only, but my guess it should SWA and not regional because from Regional it goes to BEC from SWA it goes to NPC.

Some news from my Lawyer

I got some message from my lawyer, i hope this i will help you all, i asked my lawyer to find out about my case, he gave me this info.
"I've called them, finally someone actually picked up the phone, I gave them your case# 0441****, the receptionist said your case should be still in Atlanta office, they have forwarded cases with regional receipt date Sep 03 - Dec 04 to backlog processing center.

However she cannot provide any further info as they are still working on cases around May 03 (see, the website said is Jun 03, not really accurate).

That should at least give you some idea, but of course, they don't like people calling and they didn't response to message that I left before"

Alright guys lets hope best and see how fast this guys wil clear my case.My case moved in Aug7th
thanks
kasid

Thanks for the update Kasid. Looks like they have spent much of Jan to transfer/work out details of BPC. Hopefully in Feb we will begin to hear back more on pending LCAs.

So unbelieveable!!!

My attorney called Atlanta DOL and they admitted they recorded the received date incorrectly from 06/03 to 06/04, so my case went to Philadephia!

DOL said it was a mistake but they can't do anything, because the case already went to Philadephia

Can you believe this could happen??

Oh wow, that totally sucks! Shouldn't there be a way to maybe contact Philly or force Atlanta DOL to do something. With 6/04 you could be looking at another year instead of an approval sometime this month. This is one of those things that boils down to how much hell you want to/can raise. Your would need the support of your employer/attorney.

I don't think you can push Altanta or Philly to get the case back to Atlanta. They don't think it a big deal and they won't lift a finger for such a minor problem. Not in a hundred years. You know who should be blamed for this disaster? Your dear attorney. She/he didn't do enough work. After your case went to Atlanta, she/he was supposed to contact Atlanta to get the case number for the first thing; then follow up with the case status. That's what my attorney told me. She said she contacted an officer(don't remember the name) every week to follow up all her pending cases. Don't know if she's telling the truth. At least, she found out my case number so I knew that my case was all right lying on some box at Atlanta. Well, now, it's at Philly. My file certainly had more trips than I got. Good for it.

To Sept Guys

Can any one please confirm about the Sept 2003, It process here or moved to Philly BEC?

My case went to ATLDOL on sep3,03. The lady of ATLDOL told me all cases(including sep) after sep sent to Phil. But my lawyer also checked with someone(maybe supervisor? ) in ATLDOL and said my case is still in ATLDOL. I'm so confused. Anyone has the reliable information, please share with us.

ruthcai321,

I think the only way we could find out if the sept 03 files went to BRC center is when everyone starts recieving letters from philly center. If our files went to Philly than we could be the first to get the letter from Philly from the Atlanta Region. If we don't recieve the letter and other people started recieving letters from atlanta region than it's most likely are files are still in Atlanta.

We could only wait and see, it's really confusing trying to figure out where is our files since people are getting different info.

Update from a friend's lawyer: Letters will be sent for oldest cases first and oldest cases are the ones in Philly DOL. If that is the case, Atlanta Sep 03 cases may not be picked up as soon as Philly BEC start processing. This sucks especially for those guys whose Atlanta cases are with RD at the beginning of Sep 03. In short, there is no guarantee that Atlanta cases, even if it has RD in first week of Sep03, will be picked up first. They may have to wait for Philly or other eastern state's cases.....

Yes, it may take little longer to touch our cases from Atlanta but one thing for sure, we will get a letter stating that the file is been recieve by BRC.

This case shows how important you should keep monitoring your case. If you contacted your attorney and knew the case number; if you could contact the US DOL or check the case retriever system, you would avoid the problem. Now, you may have to look forward to hearing from the BRC. Too bad, isn't it? BTW, the Atlanta US DOL still has not cleared all May 2003 cases although some specialists have been working on June 2003 cases. The best way to know your case processing status is to contact the US DOL by providing your case number, especially those May 2003 cases.
