Totally Disappointed and frustrated

Guys,
I am nearing my 6th year completion and totally frustrated. If my labor is denied for some reason it's going to be a lot of disappointment. First of all Atlanta lost my application and I had my attorney reconstruct the file and do everything all over. Now Atlanta has made another mistake and requested an evidence which is not at all applicable to me. Philly and other DOL's are warning against forum shopping, but what else would you expect everyone to do when there are unnecessary delays and mistake's everywhere in the adjudicating process.
I know i have been silent to Rajeev nair's messages as I know where it is going to land and that does not mean I have not done anything about it before. All i did to expedite the process was wasting my time.

My lawyer said, in Atlanta region, they divided the applications in to two sectors, one till june or july 2003, which is being processed by regular Federal employees, and the second from August 2003 onwards, which is being processed by Contractors from Georgia State Office.

These second sector guys started working on Aug'2003 cases, and the cases forwarded during that time period will go to these guys. so we can expect approvals from these guys as well.

The DOL website is still showing the processing date as Dec'2002 because, that is the date the regular federal people are working on.

If this is correct, we will get our approvals soon even our labor forwarded to Federal in Aug or Sepetember.

Oh that's real fair to the people who have applications dated in June/July. They must wait several months while th Aug people get approved right away. What a joke.

Yes , One of my friends labor cleared from Atlanta federal feb 04. he application forward to DOL in AUG '03 .

Its definetly fair, if you compare people from Other regions like Chicago and Denver, who apply their Labor today and look for approval next month(within months).

Another good thing is, it wont hinder the timelines for the people whose applications forwarded to DOL between Jan 2003 to June 2003. Because the same number of people are working on those cases with the same tempo.

I don't care about the other service centers, this is about Atlanta.

Bottom line: Someone who submitted in Aug should not get approved before someone who submitted in June.

Looking at this we can see how balanced and fair the DOL is.
Let the guys before june-july 03 be left at thier own fate while folks who have applied later take the fast track to I140/485.
A reasonable solution would have been to increase the work force by getting consultants from GA SESA and handle all the cases on first in first out basis instead of making two different classes.

12/23/2002 - still pending. no news.

If indeed there are two different date tracks, it flies in the face of logic and fairness.

representations, i still insist, will only improve matters worse !

remember these are federal employees. are you suggesting they will improve their work ethics when they receive a representation signed by 50 people, 25 of whom sign with pseudo-names ??

the prudent and saner way should be to contact these people via the lawyers who file the cases..

.now if that can be done ...

How did it get certified in ATL so fast?
Even my colleague or his lawyer dont know the answer.
 
I think at ATL they are running this crazy.

My guess is that the director might have told them to complete Nov cases , and so they completed Nov 02 and Nov 03 cases rather than FIFO.

OK..I ran a search for receipt dates 19/dec/2002 thru' 23/dec/2002 received at ATL - DOL with status - received at regional office. Here are the results.

There might be some records missing from this database going by comments in some previous threads.

between 19-dec and 23-dec we have 40 cases pending. no telling how many days these 40 will take.
I have stripped the salaries from the records below.

We must all join forces and send our complaints to higher authorities. Look at this now, people who file after us are also getting cleared, and people in front of us are getting cleared.

Dont anyone in this forum feel that this is an injustice done on us.

We should collectively send our request to people who can bring about the changes to fix the matter.

ATL - certifications not following a dateline

I downloaded from the database made available in the public domain by DOL and queried for cases certified in ATLANTA for receipt dates after DEC 2002.

We have some people in this thread whose receipt dates stand at DEC2002 with no feedback from the Atlanta DOL.

I enclose an excel sheet which shows certified cases starting January 2003 !

The certified cases belong to the whole spectrum of jobs and cannot be construed to be certified because of the nature of jobs.
I saw cooks, construction workers, electrical engineers, software analysts and various other occupations certified after a receipt date of Jan 2003!

Some have a receipt date as late as
10/8/2003 - Housekeeper
10/22/2003 - carpenter
10/22/2003 - sewing machine operator - all certified !!
Gimme a break !!

I hope there is an easy explanation. They owe us one.

Thx subhasri for your excel file. I found something that was very ironic in that data. Here's a little story for y'all...

In the city I live in there is a famous Indian restraunt. The owner is a good friend of mine and likes clubbing etc and we hangout all the time.
What is funny is that going thorugh subhasri's data is that 2 of his cook's got recently certified with their received dates after mine and I am still waiting in line.
These guys are straight from a village in India and cannot even write their names in English. Not that this should be the only criteria by any means but one can't help but wonder.....

They are worried whether DOL would retaliate by questioning their individual cases. Remember, these are times when DOL is finding differences between Programmer Analyst and Computer Programmer. Also, they are worried that go on question many silly things, and send RFE.

If you can write something to elevate the fear, we are expecting a lot of support.

Hello everyone. Thank you rejeevnair32 and Mickey for the progress on this one.

Rajiv, thank you for the offer.I think this would be great.
But this time I think instead of just the senators, I would prefer to send the petition to all the media agencies.

Another aspect of this excessive delay I might point - which could be added in the draft rajeevnair32 and mickey - the implicit dependancy on employer to sponsor the greencard and the H1B in which case, we are left at their mercy and this is nothing less than "bonded labor" or "slavery" as it was in the early days of the pilgrims arrival and settlement.

I am not sure if this was included, but somehow the world, now that it boasts of asking for freedom and liberty for everyone, eems to close their eyes to such implicit acts of bondage.

To sound a little humorous , we deserve amnesty for the bonded labor and slavery we have been subjected to these years.If people in Iraq deserve freedom, so do honest, tax payeing residents of the United States(albeit of a different kind).

rajeevnair32 I have gone through all the threads and the draft and I think the points I mentioned could be a wake up call for a lot of people.

I agree with you. The previous town I lived in has an indian restaurant. the person who serves there is a madrasi who is now a sardarji got his green card recently. He is a cook and waiter and everything. i visited my previous town recently and he said ' saab mera green card aa gaya .. thoda dekho sab theek hai kya' . ironically chef's / cook's etc are more deserved area's.

It is our right to petition.

Take for instance the people who are named plaintiffs in our 485 litigation. Quite to the contrary of retaliation, upon filing lawsuit, the 485 applicants who are the named plaintiffs are getting approved faster.

I asked my lawer regarding the appoval of certian cases in May-Dec'03 he says "In some instances cases are approved quicker, unfortunately, they won't specific inquires on the case until they announce that they are past your filing date"
is this true
