My attorney replied to the remand ATL might have recd the letter yesterday(02/17/04). I will post in the forum as soon as I hear again. I hope they would take action in week or 2 for remanded cases.
Also my case was remanded on Jan 26, 2004 and it has not been updated on the AVM yet as of today.

I think they are not updating the AVM..Or I don't know what's going on as if you will see 04394500 ( nov 13th case ) is still pending...

Since it was not my case (my collegue has the problem) the company did not talk to me much, for what i could extract out of my company official, it looks like ATL DOL lost some of his papers and when they opened his case for processing they did not find the papers so they rejected this case .

A dumb Q: What is the difference between remanded and denied with specifics to DOL case processing?

Remanded to employer is when there are blanks that needs to be filled in or rectified by the petitioner, in this case the employer. Could it be that his case was denied for RIR and that his case has to be filed as a non RIR ? Having said that, he would have to go through the advertisements as required by DOL. I do know of a case however (quite a while ago) that the person has to file another advertisement on a recognized web-site by the DOL for a certain time-frame before it could be approved by DOL. FYI, this person had only run one paper ad for his application.

There are a lot of people here who are equally affected by ATL DOL's delay. Please do not take a seat back and adopt a "do- nothing" approach and then jump on the band-wagon if things get a move-on. C'mon guys - lend a hand to Rajeev and support the petition. Even if nothing comes out of it, we at least have the satisfaction that something has been done to that effect. Really nothing to lose here.

Don't want to be penalized - use aliases. We are not asking for your real names, neither do we want any of our applications be jeopardized in any way. Just imagine, ATL DOL took three blinking months to process December months, which has the least application numbers. Something's got to give.

There are atleast 50 guys in this forum who are affected by ATL DOL's processing delay as of now . I am agreeing with Rajeev & NII and voicing my concern too.Atleast,let us try to pass on the message.

Also,I discussed with Rajeev about the expenses,he mentioned that the expenses will be approximately $50 to send the mail to the president, senators and representatives .

I will be definetly sending my share to him .If you guys can,please coordinate with Rajeev and let him know.
 
Good initiative

I have not yet put my application in. But I can see that from the pain people are undergoing that Rajev is on the right track. I also see myself waiting for you all like forever for the LC cert.

However having said this it also understandable why some of feel uncomfortable in becoming a part of this. So my 2 cents do what you feel is right in your personal case and join the cause if you feel it is right and just.

Rajeev does it matter if you have many peoples alises? Is it going to serve the purpose?
 
It really doesnot matter if people uses aliases.

The reason we want lot of people it is show that there are lot of people having the same problem, and it is not an individual case.

By looking a lot of names, this will make it not to write off the case as if you some an individual case issue.

We have represent this is a DOL Atlanta class issue. (Remember, senators and reprenstatives may not even be aware that we such a huge backlog exist.)

H1 extention

Hi

My GC process is going on at my family friend company and I used to work for them. Now I am not on their H1 and their H1 was expired.

Can I apply for my H1 extention with my family friend's company though I am not working for them and doesn't have valid H1 with them.

Depending upon ur reply, I have to make step. This step will be very crtical for me

Any help would be appreciated

The company needs to sponsor your H1B extension.
You can apply for extension if the company is willing to
co-operate with you and give their company paper work.
You can hire a lawyer and file the papers.
If your family friends company is not willing to sponsor
for your h1 anymore, I do not think you can get extension,
its like any other layoff.

You may check with a lawyer to make sure or join murthy
chat session, which happens every monday (at around 9:00 Pm, check ou the timing on their website..murthy.com). You can
pose your question to Ms.Murthy and get her input.
She is pretty good.
