Hi Vangaru, how did you find out your case has been approved? Did DOL send a notice to your lawyer? My case was received in Atlanta on Jan. 21, 2003, AVM still says RECEIVED..

Till now phone information retrieval system says case is in "RECEIVED" status. So, don't go by the AVM.

Don't go by the AVM. Your employer and your attorney should be receiving notice from DOL. The AVM does not display "current" reporting. You have no way of knowing when your labor will be reviewed. However, yours should be coming up soon as your DOL received date is January 21, 2004. Good luck
 
does anyone know for sure?

what happens when someone is on 7th yr extension and labor gets denied? is the 7th year H-1 still good or labor denial marks the end of H-1 status?

If labor is denied, H1-b is no good. H1-B is good till any decision is made on the Green card.

I am not sure whether it is true

I thought Green Card is for Future Employment.

H1B and GC are not related. I guess, only time GC comes in picture when seeking 7th year H1B extention while LC has been pending for more than a year.

But, if you are using your 6 year H1 limit and LC is denied, I don't think your H1B expires.

Correct me if I am wrong guys.

If the labor gets denied

1)H1 is invalid if 6 years is utilized in H1 term.
2)H1 is valid if within 6 years and will stay valid until completion of 6 years
 
Stand still

I dont see any news cases being approved.Either the forum is not being updated or ATL DOL is on stand still.
 
Case is moving

some contractor is working on my case and my attoney is asking me to sign the paper that they will send back to dol tomorrow. I will update you guys tomorrow.

Help required

Hi Friends,
One more question from my side. As you all know i got a project in Vermont region. One of my friend's company having LC cleared with Peoplesoft. If i move to that company they are ready to give LC for me. My question is i am a Java Programmer, can i use LC with PeopleSoft? I raised the same question with the company HR, 'she said there won't be any problem'. I am looking for your suggestions. Thanks in advance.

If you can get experience letters from your previous employers (before substitute LC filing date) stating that you worked in People soft, it should not be problem. Otherwise if you cant get experience letters from previous employers, you can get affidavite from previous company co-workers and get it notarized. That should help. Good luck. ;)
 
Here is my update

My RFE is regarding the college address. My lawyer said they can't believe this should be the issue. They worked so many cases, and never heard that should come to a RFE.

One thing may interest to all of you guys in this forum. Atl DOL is still hiring contractor do process our LC. My RFE request is sent by one dummy contractor they hired. They assigned cases to those contractors without even put info into the computer system. So it is no way to track who is working whose case. To me, it is very dangerous.
 
Updated status

In regards to my RFE, DOL requested previous Employer's address and verifiable letters of employment from the employers. My attorney is in the opinion that DOL wanted to verify my years of experience since the advertisements posted for my job lists minimal two (2) years experience. My attorney replied to the RFE on the same day.

Relax, you're almost there. I have a feeling that those contractors work harder and faster than formal government employees. So, my guess is that you'll get your LC very soon. One question for you, though: are you from GA? Just want to figure out if only GA filers have the luck to be handled by contractors.
