I myself spoke with DOL.

Here is the reply. We are processing 1st week of Jan application. Your case was received on Jan 30th, Call back after 4 weeks.

I asked about AVM. How often it is being updated. She said they update AVM twice every quater. That means once every 45 days. Well, that does not make any sense since I have read some postings here mentioning that AVM is being updated every week.

I guess, she doesn't know what she is talking about. Anyway, neither my employer nor my attorney has received anything. I will let you guys know as soon as I hear anything.

No! not yet. Still waiting. One of my colleague got the labor approved. I don't know the details. I will post it once I get some info.

Guys with RFE like me please let us know what is your RFE remark?. When did your attorney responded to ATL DOL ?. I guess we need to start tracking RFE dates to know what time frame we are looking to.

Please update the list with the RFE responded date. My attorney is working on my case.

Nope, nothing yet. You can bet I will update you guys whatever comes- RFE, NOF or REF. I have been in "labor" for so long, that the only feeling I have is a constant aching dull pain. Do not know what to anticipate or react anymore.

One of my friend told me that his friend's case has been send back to GA SESA to convert into regular from RIR. His case was forwarded on 2'nd week on Jan'2003. I don't have any detail about the reason behind it. I will update the forum once I get more info.

Following are some labor query explaination:

1. RFE-> Request for evidence...

In most cases..If something is shown in papers and DOL/INS is not satisfied then they can send the RFE ..

2. NOF-> Notiice of Finding..

In most cases..some document is missing..

3. Remand to Emploer->
In most cases..Advertisement problem, Singnature problem..etc..etc...

4-> Remand to State...
DOL sends the application to STATE department for review or say
start the process all over again...

5. case denied

6. case rejected

I have read some postings on other threads and RFE is not a serious issue. I wonder if some one knows if anyone's application got denied on RFE. :(

Updated pinoy's info. All RFE/NOF guys please update the list when a reply has been sent to the DOL. We need to track how long ATL takes to respond to RFE replies. I think i am the first one to reply to the Remand. I only check with my employer once a week. I do not have a direct contact with my attorney. AVM sucks.. no idea the last time it was update but it has been well over 30 days now since the last time it was updated.

Finally I can participate in this thread... Just got an email from my lawyer stating that my case has been forwarded to Atlanta on Nov. 17, 2003. Does anybody have a general idea how long it may take for DOL to "receive" a case? I hope it won't take too long, say 3 months. Do they send out receipt notice, the Atlanta people? I checked AVM using my employer phone number and there's one case with a receiving date as Nov. 20, 2003. Don't know if it is MY case. But I guess DOL couldn't be that fast. 3 days for them to receive a case? I guess no such a scenario, although I really hope so. Really glad to be here.

wlj -- you have a long wait ahead...brace yourself and smell the roses meanwhile.

It typically takes (in about 4,5 cases) i have known, 4-5 days difference between the dates your lawyer says and the actual receipt date as shown by the ATL DOL.

Your case was forward on Nov 17th and your attorney sent you an email today. That is really good work from your lawyer.

Generally, they send an email on the same day they receive the transfer notice...
