hi everybody,
i am new in this forum.can u please help me by giving the foolowing information:
i am gonna apply for asylum quickly:
1.usually what questions the asylum officers ask?
2.now a days 2009,if granted asylum,how many years i have to wait to get green card?
3.asylum officers are freindly or adversial?

please help me from your experience
 
1. the answers are in your story, every case is unique.
2. if approved this year you'd get your green card in about two years.
3. it depends on many things, but in asylum interviews I have not heard many cases where the IO was nice and friendly.....I could be wrong though.
 
what is the importance of legal representation ,i mean in the interview day,the presence of an attorney is a must or i can proceed and can be granted asylum without an attorney?
 
in my expirience, at the interview my lawyer did not say a word, but it was very helpful during the process, he guided me through the whole thing.....support documentation, story, prepare for interview, explain the asylum laws that applied to me in detail, etc.....
Many people don't do this and it's a big risk in my opinion......

If you have well founded fear of persecution, you don't have to do anything to prepare for the interview in my opinion. The officers are all humane and treat you nicely..as far I remember. What you need to prepare is for, is the facts...dont forget any facts to back up your story.

You can have a lawyer present but most lawyers talk at the end..when a decision is most likely made anyways. Many lawyers try to backup what you said or if you missed anything.

I believe like others have said that the most important thing is to have a convincing case and to know the facts. That I think is where the lawyer comes in. As for the Asylum officers, I just think you need to go prepared for all possibilities because most times they do not give you any hint as to where they are leaning. sometimes at the end your lawyer will have a clue as to what the officer was thinking based on the line of questioning. In my case, my interview was finished in 42 minutes and my lawyer said that it was a good sign.
 
I recommend that you go to youtube.com and search for a movie called "well founded fear" Youtube posted 12 parts of that movie. You should watch all parts and you will get an idea of what the interview looks like.

You should read your latest country report from the Department of State website.
Winning an asylum case boils down to two things - having bad country conditions according to the Department of State report and having a credible story of persecution either past or future, or both. The story of persecution will be successful if it is consistent and shows that you were or will be singled out for persecution.
It will be better for you to get an attorney, but only a very good attorney. Asylum cases are very hard to win and only a very good attorney with experience in asylum cases can help you.

My experience is a little bit unique. I never had any experience with the Asylum Officers. USCIS arrested me for being out of status. My case was decided in Immigration Court.

My case was different because I never faced past persecution. I left my COP when I was a kid. However, there was a potential for future persecution if I was deported to my COP because of the kind of treatment my relatives faced back in my COP. My parents don't live in my COP and have not lived there for over 30 years.

For a successful asylum case, you really have to prove potential future persecution you might face if you get deported to your COP. Past persecution you have faced also helps your case. You can do this by providing your country's human rights report provided by the Dept of State. This document is very powerful. Provide newspaper clippings to support your case. Provide written affidavits from prominent people to support your claim. These documents will really help the decision maker make the right decision.

Every asylum case is unique. All we can do here is provide with our own experiences to help other people. All you can do is get educated about the process. This forums has been very helpful to me. I also suggest you go to the USCIS website and read and understand the asylum process that really help me. I did the whole process without an attorney not because I was smart but because I could not afford one. I was out of status in this country for over eight years when I got arrested by the USCIS. No attorney gave me a chance and most of them had guaranteed me deportation.

If the Asylum Officer denies your case, that is not the end of the world. You have the opportunity to go to Immigration Court. You get denied again, you can appeal the decision. This is a long process or it could be a short one. One important thing, if you are not comfortable with the English Language, take a translator with you.

By the way, does the BD at the end of your username mean Bangladesh? If so I am also from Bangladesh.

Are you saying that you went to face the judge without an attorney and you wont the case? Wow that was almost a miracle. I should've done that. I paid over $2000 for an attorney to let him come with me to the interview and he has not talked that much. The application was so easy to fill out. Now, I am thinking of facing the judge by myself if I get referred to the court. The attorney charges over $5000 and that is a lot for me. My case is not weak and I am facing a future persecution and the state depatment report supports my claim. Do you think I should pay over $5000 to hire an attorney even if my case is strong?
