hello

I was born in India and went to bangladesh with my parents. I came to USA on a bangladesh passport which says my birthplace is bangladesh otherwise i couldnt have availed bangladeshi passport. Since bangladeshis have become quite hostile to it's christian and other minorities i am applying for asylum in the USA. Can i tell them my actual birth place is india in the application form though my passport stated birthplace to be bangladesh and also in USA gov record my birthplace is bangladesh. Can i tell them the truth.
 
nice! so you are actually asking whether to lie on your application? keep in mind that every post here logs the ip address of the computer and you can be tracked down easily.
 
I would suggest you get a lawyer for this. I am confused however as to why your birthplace has any indication as to your nationality. You could have been born in India to Bangladeshi parents and be a citizen of Bangladesh - hence obtaining the Bangladeshi passport.
 
Glad you joined the forum. If your passport etc shows country of birth to be bangladesh then stick with it. How old were you when you came to bangladesh? I understand yrou concerned but this will cause more issues for you. As far as I am concerned you are a citizen of Bangladesh.

Samird, this is not how you welcome a new member. His concern is guenine and I dont see as he is trying to cheat.
 
Just tell the truth whatever it is. BTW a friend of mine is a moderator on one forum in UK and I guess because of the recent events, he has to provide daily logs of the web-server acticity to the police.

my parents were bengali spekaing christians from calcutta. they went to bangladesh for business and stayed there. If someone mention his birthplace to be india in bangladesh he wont get passport.

Well see the issue may be that if you state that you were born in India then they will surely deny your asylum application because they will tell you to go to India where you wont be appressed. Thats my take on it.

I totally agree with you CP1. I was going to write the same. India is not a problem city as far as Christianity is concerned. If he shows that his birth country is India and he has the proof for the claim, he may lose the chance for the asylum. But ofcourse it's upto JH to decide.

JH: WHY do you want to make this change?
 
when i left india i was only 8 years old and never got back there. i look like more of bangladeshi than indian now. i can not get back to india to claim indian nationality since i do not have left anything back in india. my parents are no more. all of my life i lived in bangladesh i am 27 years now. all i have with is a primary school certificate from india.

Why do you want to make this change JH? Unless it is very neccessary, the advice to you is not to. Anyway, it will be of no use as USCIS will only put down whats in your passport. Dont spoil your case.
 
Well your passport says You are Bangladeshi born so thats what it is and thats what you should stick with in my opinion. If you say you are born in India and show that your passport says born in Bangaladesh..that may be seen as fraud in Immigrations eyes.They would claim its a fake passport...and they would claim you used a fake passport to obtain a visa..

As other board members said, India is a safe country, your asylum may be denied and you would be asked to go there.

Hire a good lawyer and stick with one story when you make up your mind.

I can understand your dilemma. I think the only time you'd have trouble if you stick to your story that you are Bangladeshi, is when they will ask you for your birth certificate. If you were born in India, obviously your birth certificate will indicate that. Now, that some people are advising you to state that you are born in Bangladesh, I don't know how you can do that without a fake birth certificate from Bangladesh?

If your passport is legit. Bangaladeshi embassy will issue you a birth certificate saying you were born in Bangladesh as it says in your passport. They would still verify with their offices in Bangladesh to make sure your passport is legitmate....USCIS will accept that because many 3rd world countries rarely issued birth certificates..

Now this is interesting issue. So it is legitimate reason to contact the embassy for birth certificate but is not to renew the NP?

Let's put this aside for a moment. What if your embassy is just not issuing birth certs, which is the case with my country. They actually require somebody to go to the local county courthouse in the country to get it. It can be anyone. So let's say you call a friend and he/she obtain the certificate and DHL it to US. Would this be some sort of 'connecting with the country' of prosecution?

So one can obtain BC and not NP?
 
My take

My take on this issue will be tell the truth to your lawyer that you were born in India but your parents took you to Bangladesh when you were 8 and you have no ties with India since then and you no longer consider India your country. I think that will be better that fabricating one lie after another to hide the truth. Do you know that if you somehow manage to get this birth certificate from your embassy to indicate that you were born in Bangladesh. Even after you acquire citizenship of US and they somehow find out that you weren't Born in Bangladesh, they can technically strip you off the U.S. citizenship based on the argument that it was attained by falsifying.
Point of the matter is that honesty is the best policy. I wouldn't advise otherwise but that is just my opinion.

thank your for your valuable opinion. i do have a school certificate from india which states my place of birth to be calcutta and i have a brith certificate as well from calcutta. what would happen if i tell them now that my actual birthplace is india and not bangladesh as on my passport.
