Asylum status as an illegal/refugee

future refugee

I wonder if it would be possible to apply for an asylum status by trying to enter the States illegally(ie. without a valid visa) and at customs claim fear or prosecution. I mean basically just get on the flight and tell the customs/immigration/INS I dont want to go back, I can't go back due to fear or prosecution. (basically what are the requirements? political or is a group of people enough?)

Or is a valid visa required for the status?
I'm well aware they would just detain me and the process can take a while but i'm ready for the battle.

Second, I wonder what are the chances for a caucasian european from to become a legal refugee? The INS is probably going to be looking all weird but does it matter in the end?

1. No Airline will let you board the plane unless you have a valid visa or any sort of document that will ensure your entry in the States. Airlines get fine big if they let you arrive in the U.S. without a visa. Many refugees use fake visas or passports.

2. If you try to request asylum at the Port of Entry, make sure you have a REAL FEAR OF PERSECUTION. It is not easy to obtain a positive recommendation at the CBP. They can deny your request and expedite your deportation within hours. They can detain you for days... and it can be very stressfull.

If you still want to try this, make sure you bring documentation of your persecution. check this webiste to see if you qualify for asylum.

I don't know about 3rd world countries but all the European countries are in a visa waiver program and anyone can visit in the States and stay 90 days or less.
Some though have to apply for a visa but the only one asking for it is the CBP after landing. So getting in the plane isn't the problem but the customs.

Not ALL European countries qualify for the Visa Waiver. And I don't think you're allowed to say "3rd World Country" anymore. If you are a citizen of one of the 27 countries that participates in the Visa Waiver program, why in the world would you claim asylum at the Port of Entry? Like Mr. CCordova624 said, there is always a chance that you will be detained under deplorable conditions at a detention facility till the time of your case.

If you have a "well founded fear of persecution," then bring necessary documents, and proof, and file for asylum once you have been admitted into the US.

As far as becoming a "legal refugee," I believe you will need to contact the UNHCR or the US Embassy in the country from which you intend to flee. They will evaluate your eligibility on becoming a refugee. And the color of your skin does not matter. Just because you're a "caucasian European" does not disbar you from applying for asylum or being considered as a refugee.
