Asylum Seeker..please HELP!!!! (ESPICIALLY FATEN AND RAZIEL)

hello,
I am an asylum seeker...changed my religon recently after years of thinking..the problem is that in my country leaving the major religon is considered as a crime by many organiztion...and I was threatened many times to return back..but I refused.
I thought many times of asking asylum in USA..especially I have a valid B-1 VISA.

What do you think I should do?

I also have a few questions

1-why are some people thrown in jails when they ask for asylum in USA?

2-why does it take more than 3 or 4 months to schedule an interview after filling the I-589 application..although the official site says its max of 43 days?

3-why does it take more than 2 weeks (sometimes months) to recieve a decision

4-If all my papers are OK and they found that I really face pesecution..what is my chance of being granted asylum.

5-when can I apply for work authorization exactly?

6-I saw people in similar threads complaining about the long processing times of the GC?? (14 years)..while others like faten said it only takes from 6 to 12 months only..HOW????

please help me..I am really in a trouble!!

actually i am NOT an asylee, I am a derivitve asylee,

which means my dad is asylee and applied for me to come to the usa.

as a derivitive i should stay one year and then apply for gc.

about my dad it took him very long time to get the gc

and beleive or not he did not get the card untill today!!!!!


I have no experiance at all in the saylum or how everything is going on with the immegration,
my lawyer too said that to me and my dad, how the daughter get the gc before the father....!!!

here are the answer for your questions:

1- never heard of that, what is your source?

2- some rare cases for rare reasons

3- Asylum office decision is somewhat quick "except for some cases" but the final approval might take long time due to FBI name check

4- 50%

5- after recommended approval or after 150 days from submitting asylum application.

6- not the time to worry about GC


I really don't know why you feel you are in trouble... get a good lawyer for the case and submit the application, may your new "God" be with you.

3. Yes, sometimes it takes months to receive a decision. I am still waiting for a decision. I have been waiting for almost 4 months to receive a decision (recommened approval or referral). Some people are lucky and get a recommended approval within 2 weeks and some people live in uncertainity for months and don't even know if they will be approved/denied. So you will have to be ready mentally to live in a limbo for months unless if you are lucky.

1-never mind, it seems they do so to people who enter USA with no or unvalid travel documents (not our case)

4-thats a fair chance, but I think it depends on each one's case

6-please, try to explain more.I read that you have the right to apply for GC 1 year after u granted asylum,but how long it takes to have GC in hands???.
btw, I downloaded an excel sheet showing the number of people who were granted GC due to asylum from 1999 to 2008, it shows that until 2005 the number was almost 10,00 annually....but in 2006 it increased dramatically to 116,000! then 90,000 and 80,000 in 2007 and 2008.
do you think these numbers has any effect on the processing times.

not sometimes but rarely


So you will have to be ready mentally to live in a limbo for months unless if you are lucky.

if you didn't get the decision in 2 weeks, it doesn't mean that all cases are the same, I have a lot of asylee friends and I know that they get the decision in 2 - 3 weeks, how many do you know still waiting for the initial decision like you?

in the past, asylees had limitation in the number of GC issued, the limitation has been removed and so you can get your GC in 4- 12 months after applying.

this depends on FBI check also, and your case complications "like if terrorists did take money from you or not, or did you use false documents to enter USA so I-602 waiver must be granted"

As far as I know, there are 3 members of this forums that are still waiting for a decision and several who got a decision in the past after waiting for many months.
 
Am one of those who waited for months and when i finally received my decision, i was referred to IJ in 2005 and got my approval in 2008.

I have a question mamatonny..were you referred to the IJ right away after the decision?or it took some time...and during the time between 2005 and 2008 could you apply for EAD and worl legally.

After my interview, i waited for a few months then i got the a letter in the mail telling me that i was referred to IJ for my case and the date was one year away for the first Master calender hearing and after master calender hearing, i was given another date one year away for my individual hearing. After yu apply for asylum, yu can apply for work authorization after 15odays. so i had already aplied for work authorization and was working this whole time renewing my card every year.

Do employers recognize this kind of EAD? Is it a violation of a law for employers to deny this EAD?
 
they do recognize it and it is the same EAD you would get after asylum approval, no difference.
 
I have faced such a matter when i wanted to join the army, they wanted a GC as a minimum. Asylee is not considered as a Permenent resident to them :(

as for the private sector, they only want to see your EAD, if they ask for a GC, either it is a requirement for security reasons "just like the army" or they are new in business

I hope there are no rare cases that make people also wait months to receive EAD.
 
to raziel ,
i have one questions to u.that is u mentioned about case complications like"terrotist took money" which led to GC delay. can u please explain it to me?thanks in advance
