Asylum rejected

I was wondering if any of you could tell me where to find the IJ's name ( who's going to interview you) in the Notice of Appear. I read it three times and still couldn't find any names.

You can call 1-800-898-7180 and it will give you information on when your hearing is, who is going to be your judge and it will also tell your clock.
 
This is very weird. I just called the number above and the voice recorded message skipped the judge's name. Your hearing is scheduled on June 18th at 1 pm before Judge (pause) at Los Angeles court 15th floor. :confused: :confused: :confused:

Thats probably because they haven't assigned the case to anyone yet or haven't updated their system. Try back 5 or 6 days before the scheduled date.

It turns out that during court proceedings, the burden of proof is on the prosecution to prove that you do not deserve the asylum. All you need to show is that the situation in your COP hasn't changed, and that you are likely to be persecuted if you come back. Connect the dots!

Use country reports by Ammesty International, Red Cross, CIA, etc etc. Your lawyer should know that, if he doesnt... fire him!

That's not true. The burden of proof is on you entirely, the DHS attorney doesn't have the burden of proof in your case. Both IJ and DHS attorney will question your credibility during your testimony and the actual facts of your case. The DHS attorney may decide to send the documents from your case to the American embassy in your COP into their fraud department to investigate. You have to be prepared for anything. Country reports don't matter much. Its your credibility that matters the most. So, don't fire your lawyer just yet.
 
Very informative article. However, according to it, it seems that the burden of proof to deny asylum is on DHS. They need to prove why the applicant(s) should not be granted asylum (as long as there are evidence of fear of past persecution). Right?
 
Burden of proof is on both sides. You have to prove why you are eligible for asylum and the DHS attorney has to prove why you should not get asylum and them from the testimony heard, the judge will make the decision. You are allowed to bring witnesses if you want. Also, in my opinion, if you have newspaper articles to prove what you are saying, I think that is the best evidence.
