Asylum on k visa before marriage??

Hi,
Although this is my first post but I am reading on this website for quite a long time. Thankyou so much for great work.

I have some questions about my brother who just entered US on a k visa. I wanted to ask, can he apply for asylum instead of getting married. Or does he have to get married in order to stay in the US. The visa is still valid and will expire in May. On what conditions he can apply for a asylum before marriage or can he ever apply for asylum on k visa.
