Asylum and GC through employment question

I am now a Recommended Approved Asylum applicant, it has been a year +. I was wondering if it is possible to also apply for a GC through employment at the same time as my Asylum application since my boss seems to want to sponsor me?

Yes you can (most likely you have to go abroad for processing) but it is basically pointless. You will have to go throught the same battery of background checks if you are applying for your EB green card. Whatever problem that is holding up your final grant of asylum will surface again when you are applying for your employment based green card.

Any news from the asylum office? Do you have an attorney?
 
I went there to check but got the same answer from the clerk: " Looks like your finger print check and background check are cleared, now it depends on your IO". This is really getting on to me. I am very impatient now !!

If it meant that the checks have been done and the officer is too lazy to process the file, it is unacceptable. Have you tried to speak to the director of the asylum office? File a complaint with the asylum headquarters in DC? As a last resort you can sue the asylum office in court (people have successfully sued the USCIS to force them to process applications).

I sent you a phone number via PM. Call them and PLEASE BE POLITE. The more reasonable you sound the more likely you are to get help from the people at asylum headquarters. Being rude will not serve you well.

As for suing there is a very helpful thread created by Lazerthegreat. Look for it.

I was in the same boat as vinisterz for the past 3 years. My name check FINALLY clearded and just got my final approval of Asylum last week! I would like to explore the option of getting an employment based GC. I know that I cannot apply for my Asylum based GC for another year and that it will be backdated and blah blah....

1. What are the pros and cons of applying for a employment based GC other than the obvious cost of the application?
2. Will that application be processed faster since I JUST finished a name check for my initial Asylum application?
3. What are the steps needed to apply for an employment based GC if I don't need an H-1 visa or anything of that sort? Is there a waiting period?
4. I'm guessing the whole hassle with the renewing of the NP, and getting an RTD, visiting COP (not that I want to) and the game of being an asylee will not pertain to me anymore once I get an employment based GC.

Any thoughts? Thank you for your opinions in advance.

1. The cons are: more mental aggravation that inevitably comes with dealing with the immigration agency; you will be beholden to your employer and your proofessional mobility will be severely restricted; there is no assurance that you will succeed (whereas an asylum green card is almost a slam dunk barring unusual circumstances).

2. There are a number of steps that need to be finished before they are ready to process your green card (that is when your background check comes into play).

3. The whole process will take longer than the asylum-based green card route.

Also you will have to go abroad for processing (at an embassy).

The manner in which you entered the United States could also disqualify you from getting a green card via employment.
 
ASSYLEE, congrats Im so envious of you right now. but I know mine will come soon.

Thankful, I called the number and an Asylum Officer will inquire my application status at the anaheim office letting me know of it via mail.

Thank you very much for the info. at least Now i can rest knowing that i did an extra step of effort.
