Hi, everybody, I have a serious problem, my father get his green card by granted asylum, then he apply I-730 to let my mother and me come America, on our passport there is stamp says that we are granted asylee. These days, we file I-485 to adjust our status based on granted asylee live in America more than one year, so what kind of greed card we will get, can we go back to China without any problem cause my father use this way to let us come here but we have no idea what he did, I really need help, please help me.

(1)In an ideal world as far as conforming to the asylum standard rules and regulation Derivative Asylees could freely go back to their home country, with no risk of asylum revoke.

(2)However China has a nasty history of mistreating Chinese asylees residing abroad when they conduct a temporary visit back in china, chances are you experience the same hardship.

(3)There is no Expert in this forum, that’s your prerogative to either go now or wait until you become U.S naturalized citizen. Don’t let anyone confuse you, the decision is yours, there are things that no one can predict.

Best luck

Themen, outta curiosity, I wish to ask what's your qualification? I have a question related to visiting COP too. ( my current immigration status is Derivative Asylee ).

Why so many Chinese asylees, regardless of primary or derivative, want to go back to China? I am kind of confused.

I am also confused by this.

In New York City a few years back, a bunch of new Chinese asylees were photographed by undercover FBI agents hosting visiting senior Chinese communist officials in fancy restaurants. I did not make this up.

The.Walker,
I am a Law Student, part time para-Legal, Also worked for san francisco DA's Office as an intern, "Child support invitation Unit", Certified translator...
I passed the Bar in my country of origin and was never a Lawyer (but doesn't nothing in US), I then consequently restarted from scratch. I am on my final year (Hasting College San Francisco, Ca), hopefully I will soon be a Civil Right Attorney. Many Law firm offering me full time after passage of BAR exam.

Best Luck to all of us.

Thanks for asking.

Hi deandai.
You will be getting category AS8 green card. Which is the one I am holding right now. I do not think you will have any trouble for going back to China and coming back to USA. I went to China last winter for a short visit, my aunt she have visited China many many times and my cousins have visited China. We all came back without any issues. We all have either AS7 or AS8 green cards. I'm assuming you are from Fujian?

Han Huang,
Did you show the official in China your GC? Didn't they notice that you have AS category in your GC? I am curious to hear your story.....

Yes I did show them my Green Card. I'm not sure if they noticed my category. They did take a look.

Wow,
You were so lucky my friend!

I guess. I mean seriously, I haven't hear anyone who got denied by Chinese government for leaving the country because of AS category green card. I did hear people who got denied to leave the country because they are falungong.
I also hear some stories about AS6 people got their green card taken away by USCIS.

I know a lot of people they either AS6, AS7, or AS8 green cards. They all went back to China before.

AS8 category should be perfectly fine, although AS7 category may get some issues, especially in the original asylum application the principal asylee mentioned about the persecution to both the principal and his spouse. Therefore AS7 category's visit may appear to be a little inconsistent with the original application. However, these are really remote possibilities.

Good luck to your visit.

Hi hanhuang
Thank you very much .
That is a good news to me. I read newspaper these days, from the report.
I knew some Chinese lost their Aslyum GC when they came back to USA from China after Chinese New Year, I was afraid, why this happen.
Is it a law or regulation that forbid AS8 GC hold came back?
