Dear Friends,

I have been granted Asylum on 7 months ago, last week my father received a letter from the National Visa Center saying that the application he filed years ago (I-130, unmarried son of LPR) is approved.
They are saying if we don't respond with in one year the application will be canceled.
They recommend replying, and if we don't want it to be processed we have to state why.

My question is: if we reply and request termination of the immigrant visa because the beneficiary (me) is currently in USA under Asylee status and will adjust to PR on June 09. DOES THAT HAVE ANY NEGATIVE IMPACT ON MY ASYLEE STATUS OR IN THE FUTURE WHEN I APPLY FOR I-485.

Thanks,

I think if you apply under your dad now, you'll be given a green card immediately, right? As an asylee, you can apply later this year, but you'll have to wait a while for the application to be processed. I'm not 100% sure how long it'll take through your dad, but it should be faster, since you've already been approved.

no no. It depends on when the I-130 was filed, the age of the poster and where he was born. Ther are many other hoops to jump through. It is much much easier to stick with the asylum route.

It will have no impact.

Dear All, Thank you for ur reply, The I-130 was filed 10 years ago (unmarried son over 21 of LPR), now I'm married and I guess being married will make me ineligible to get the visa.

I Agree with Thankful and I guess it easier to adjust next June through Asylum and therefore I'm not interested in receiving it, my only concern is whether the reply to the NVC will affect my ability to adjust next June or my Asylee Status.

Should i reply or just leave it and it would be canceled a year from now? what do you guys advise

Thanks again in advance,

Even if your I-130 is approved & if you are still eligible. you still have to wait for a visa # to be available for you in order to adjust your status.. which could take few years ...

Is your dad a citizen now? If he is not your I-130 is not valid because of your marriage. So forget it and focus on the asylum route.
