Asylee .. Initial Georgia driver's license! .. Issues

My wife (a Derivative Asylee) has following docs:

1. I-94 (having her picture with ‘asylum status granted’ and ‘valid indefinite’ endorsements),
2. Valid ID Card from state of California,
3. Unrestricted Social Security card
4. Birth Certificate with English translation
5. Proof of Residence in state of Georgia
6. Proof of I-730 approval.

She also has following expired docs:

1. Expired RTD
2. Expired EAD (she did not renew it because it was not needed any more per Ngwanyia v. Ashcroft)

She doesn’t have following docs:

1. NP…. because we misplaced it (a police report was filed).
2. Asylum granted and/or approval letter … because her individual asylum application was administratively closed once USCIS issued her I-94 based on her I-730 approval.
3. Copy of legal entry stamp ... because she had EWI

Drivers License issuing office of State of Georgia did not accept her application for an initial Georgia Driver’s License because they wanted her to show following docs which she doesn’t have:

1. NP with ‘valid Visa + immigration entry stamp’ and/or ‘USCIS issued EAD’

I tried my best to convince their front desk lady that ‘being an Asylee’ my wife doesn’t need EAD any more and they should accept USCIS issued I-94 instead, initially she refused listening to me but finally she allowed me to speak with her senior lady…..And to my surprise, I found their senior officer to be highly uneducated and dumb …. She even started saying that my wife is not even an asylee any more because she was issued an EAD as well. And .. she specifically mentioned that once we get a renewed EAD then they will issue her a Drivers License with the same expiry date as of her EAD.

Please help/advice

What should I do?
Whom should I speak with?
What Govt documents should I take with me so that I could convince them?

Bunch of idiots at the frontdesk.. Just request you need to speak with a supervisor and if he/she gives a problem request you will need to talk to someone above her.

I went through the same process a year ago (before my GC) only that the official this time was a black man with a nasty, nasty attitude.

I explained to him my situation, showed him my documents. He refused to issue a 5 year DL. The very next day I contacted the main office in the state's capital. I live in Florida. Well....of course the person I spoke to knew the regulations and acknowledged the mistake. I was redirected a another office with a larger staff. Same problem there as well.This time I went prepared though. I hurdled through the first idiot (an overweight woman dumb as a stone). Her supervisor thought he had me until I had him call the main office. Later, he came out saying that YES....I should have been issued a 5 year.

Well....now he wanted me to pay an extra $15. I refused. I said I'm not leaving until you give me a new card and I'm not paying for it. He did it for free.

With my new card I headed to the first office. Remember that nasty black man. Well....I recalled his name is Tony. So I found him and showed him the card. Told him what I went through because of his incompetence. The b@stard insulted me and that's all I needed. I asked him to come with me outside. I swear....all these years of sacrifice meant nothing. I was ready to burn everything down and not deprave myself of the satisfaction of teaching him a lesson. He never came outside though. Too scared to do that.

I wrote letters to everyone withing the DMV power structure. I received a response saying that an inquiry had been initiated.

I just hope I don't see him outside someday.

MY ADVICE.....CONTACT THE STATE"S OFFICE DMV. SPEAK TO SOMEONE AND REMEMBER THEIR NAME. HAVE THE animal AT YOUR OFFICE CALL THEM. THESE PEOPLE BEHAVE ONLY WITH VIOLENCE>
 
Ok I see what is going on Each state has different laws--- here is what George says about NON-CITIZEN trying to acquire a Driver License in GA.

Information for non US Citizens

To obtain a Georgia driver's license or identification card, a non US citizen must present one of the following immigration documents that prove legal presence in the US:

1. Valid (not expired) passport with I-94 or I-551
2. Temporary resident alien card
3. Permanent resident alien card
4. Employment Authorization Card

A Georgia driver's license or identification card may be issued with an expiration date that matches the immigration documentation expiration date, but no longer than 5 years. If there is no expiration date on the immigration documentation, a license/identification card can only be issued for a period of 1 year. The cost of the license/ID is $20.

A non US citizen must present their immigration documentation every time service is requested pertaining to a driver's license or identification card. This includes renewal, replacement or name and address changes, as well as all other transactions performed by Georgia Department of Driver Services.

If i was you i dont know how long it takes for an EAD but they have 2 years and i beleive upto 10 years EAD.. Maybe that might be an option though
 
I believe your wife need eather RTD or EA. In other words one additional document from Immigration. My son recently got his license in NY. This is what they wanted.

I received my Green Card with an expiration date in 2018 a couple days ago.
I went to renew my driver license and they gave me a license for only one year. I thought it is five? is it just a mistake on the DMV's side or is there a new law they follow? What should I do to get the 5 year license?:mad::confused:
 
Each state has its own rules on this issue. Georgia is very strict with respect to the specific documents it requires. Your best bet is to talk to someone in headquarters.
