Hi folks,
I just want to ask a question related to the greencard through asylum approval.I know the future applicant can apply after one year after he or she was granted asylum right?
The first question:My cousin and i want to go to paris (France) for a visit, I'm a green card holder and get my travel doc, but my cousin is still an asylee, we're wondering if he can come with us..maybe his visit can affect his greencard application next year.Don't you think so???
The second is related to the number of greencards available for asylees each year, is it 5000 0r 10000???
Finally the forth, do you guys think he can participate to the DV Lottery 2010?

Your cousin can go to France without worring about his Green Card application as long as he has a valid travel document. I travelled overseas 3-4 times before I became a permanent resident. As far as I know currently there is no limit of green cards available for asylees each year. I think it takes about a year for asylum-based I-485 to get processed. So I would say it doesn't really make sense for your cousin to participate in DV lottery for 2010 since he might be able to get asylum-based GC sooner than 2010, although he is eligible to do so.

I would advise your cousin NOT to take part in the DV Lottery, especially if he or she overstayed their visa or entered the country illegally. I'm under the impression that an asylee is only really excused from those types of "illegal" activities once an Asylum based green card is applied for. If you apply for the DV Lottery before that, I'm not sure of how immigration will handle it. If your cousin by some miracle does win the lottery, they will receive instructions to go back to their home country to apply for the green card. It makes no sense to return especially since your cousin is seeking asylum from that country! Please let your cousin know to keep it simple and just wait for the Asylum based green card. Hope that helps!

Your cousin can leave the United States without a problem if he has a refugee travel document from the DHS. The harder question is if France will let him in. Call the French consulate.

There is no limit to the number of asylee green cards available. There was one in the past but Congress changed that.

There's a way to apply for GC without having to go back to your homecountry if you win the visa lottery (as long as you have legal status here - eg. student/asylee/etc). Get a first rate lawyer and he/she would tell you how. That happened several time to the people I know personally. Your friend is eligible to take the chance and this lottery applies to any legal visitor in US land. That's what I know.
