Assets & AOS help please

I have 2 questions that if anyone could answer, you'd be reducing my anxieties a HUGE amount. Thanks!

ASSETS: I know we are required to show a list of our assets at the interview. I don't have all that many. I have been living in the US under an O-1 visa for almost 2 years, and as an artist don't really have a "job offer" as such. Does anyone know exactly what they will require from me?

AOS: Well actually, that's the thing. I chose NOT to adjust my status as a lawyer had advised me that often by the time the US interviews come round, the visas have usually run out. So I will be interviewed in my home country. Can they penalize me for this?

First your easiest question which is the AOS question....NO they can't penalize you at all. Maybe in previous years they run out of visa's by the time of a high case number but as the numbers have shoned, in the last year not all visa's have been given out...so it is up to you what to choose and look at your case number and if your lawyer recommend it and you trust him, than follow his instructions.

The other question...the might ask from you to have a sponsor form to be filled out if you don't have enough savings or funds.
If you know some one who is willing to do that for you that would be great.
 
I would assume if you are an independent artist, you will have income and still filing your income tax? You can also show your bank statement or your house too.

I did AOS and at that time I was on H4 due to my husband was on H1B. Both of us at that time had EAD as a result of the H1B. My case number considered to be high for OC region, but I did AOS anyway and visas are still available. I would say it depends on your case number. If your case number is low, I would recommend AOS, if high, CP will be safer. And no, they cannot penalize you. It's your choice.
