Are pay stubs required for H1 transfer???(legitimacy of previous thread)

Hello All,

I had the notion that for H1 transfer one requires 2-4 pay stubs and it is difficult without that. But i came across this posting regarding H1 transfer.
Can someone throw some light on the legitimacy of this.

Need help urgent

Hi All

I am in the same position as Guddu. I got my H1 visa approved from company A only on 19th jan and now i got a job offer from a reputable company B. I need to transfer From Company A to Company B. no pay stubs from Company A. As they kept me on bench till now . Now i need help please please :o . I really apprciate if someone can help and advice me through this as soon as possible.

if you do a *New H1B* petition rather than the *H1B transfer* then you will not need the paystubs from the previous employer.

Wht is the final say??

But since the H1 quota is over new H1 cannot be filed now. So still the question remains that an immediate transfer of H1 is possible or not. Logically since u worked for the original firm A for only few days, or may be did not even join in which case H1 transfer is filed say the next day of your H1 approval.

So wht is the final say on this??
 
Paystub Issue

Hey guys,

I switched from Company A to Company B in June of 2004.

I transferred my H1B

I went to Canada (Toronto) and got a successful stamping done on January 19th 2005.

I took all of my recent paystubs and even Tax forms but the officer didnt check any of those. All he asked for was the Approval Notice and the Employment Letter.

This was my case. I dont know how other Visa officers would be.
 
The case here is different.

What we are wondering is wht happens if one never works for the original H1 sponsor. Or works just for say 8-10 days.
In this case logically also there are no pay stubs possible.

Would USCIS approve a H1 transfer in this kind of situation. And what happens if your transfer is rejected but you have worked all along during the transfer process with the new employer?? It cannot be illegal as the rules say that you can start to work immediately on getting the transfer receipt.

In any case if the H1 transfer is rejected, does that also jeopardize the chances of getting a new H1 from the second company.

Ginnu and other gurus, pls pls help.

H1b transfer without payslips is possible

I was able to successful transfer my H1B from Company A to Company B in August 2004 without payslips from Company A. I was employed by Company A for approx 4 weeks but on the bench and hence received no pay. All Company B lawyers required was letter from Company A stating that I was employed with them, start date and that employment was permanent. You need such a letter for many other purposes such as car loans, leases, opening bank account etc if you are hestitant to alert Company to your intention to transfer. My transfer was approved in a week with I-94 attached.
