Are new companies able to see my current TN status?

Hi all,

I am currently working on a TN visa and have a potential new job that will apply for another TN for me. I have not disclosed that I am on a TN for personal reasons and wanted to know if the new company is privy to my status. I don't see how they could know and if I am lawfully required to tell them?

Your TN status is not public information. At some point, y\our sponsor will need -- at a minimum -- to write you a letter in support of your getting a new TN. When do you plan to ask?
 
The potential new employer gave me a form to sign out, it asks if I have or had any work visas. It looks more like they want information about H1b or other visas not pertaining to TN. They said they would submit for pre approval direct to customs. So it sounds like I do not need to tell them about my current TN status. This is great news, thank you so much for the reply. See below Form I need to fill out. Two questions at min provide a point for me to list my TN visa if I want to offer this information. Hopefully by not doing so there are no ramifications. It will be required m within 2 weeks to start the process.

Green Card Status and History:

It sounds like this new company has a protocol for dealing with onboarding employees who have restricted work authorizations. This suggests they are not unfamiliar with such people nor are they particularly biased against hiring them.

So what's the problem with being straight-up with them?

If you are hoping to get fully hired without this new employer discovering you aren't citizen/PR, then that seems an unrealistic goal.
 
I just joined the company I'm at and they got me a TN visa. On my way over to the US the new company called me for an interview (it's the company I want to be at). I thought it would look bad if I said I just started a new job and willing to leave for this new position ( maybe it was a poor choice but I still feel bad about jumping ship) I still have employment at my Canadian company as my resignation was 4 weeks long. So I just stuck to my current job as the Canadian one. I wasn't sure how to explain my situation and they never asked so I just kept my occupation as the Canadian one. A bit of a pickle now but I think since I'm not under a SSN yet, I do not need to disclose my current TN status, as it's apparent a person on a TN visa can have more then one job with a TN.
 
I'm in the same boat, wondering how your process went? Did the new company ever find out you were already on TN visa with another company? Were there issues with applying for second TN with US immigration when they can see you just recently applied for one with a different company?
 
I ended up putting my tn visa on the questionnaire from new employer.
However, there is no way for them to know you had a TN, it’s not public.

Border control had no issue with multiple tn’s in a short timeframe
 
I think you should state clearly your TN status and if they want to hire you -they need to provide supporting letter So new company will find out that you lied on questionnaire.
Employer may find this lie, cheating and fraud...this are big words in legal world. Why to get in trouble you can get new TN for new employer and join them after few weeks.

Maybe you are right maybe NOT
Say if your new employer choose to file I129 form to get your TN and send it to USCIS for processing based on your 'lie'.
also to fill I129 all your passport details etc are needed....incase 'someone smarter' goes to CBP website enter all your info they can see your status

Why to lie and get banned/barred by USCIS
keep it simple and honest
