LUD has never changed since FP1 in June 2003
Inquiry By attorney on Nov 3, 2004. No response yet. Called USCIS and initiated another inquiry myself on Dec 3 .

Common you guys - no girlie men allowed here ;)

I checked all your details, and except from a few, most of us April filers have had one or more LUD changes in November. I don't think that would happen if our files were lost.

Our aprovals are probably just arround the corner for most of us. :)
 
Apr 1 2003 cases

Here are some statistics that I gathered recently (yesterday) on 290 I485 cases with ND 1 Apr 2003:

Initial message: 93
Finger print received: 76
Responded to applicant request: 13
Outstanding RFE requests: 13
RFE responses: 3
Reopened: 2
Transferred: 81
Miscellaneous: 3 (insufficient payment, etc.)
Approved: 0
Card ordered: 6 (2 in 2003, 3 in Jan 2004, 1 in Nov 2004)

My own details:

ND: 1 Apr 2003
FP scheduled: 16 Nov 2004
FP received (online status updated): 23 Nov 2004
No updates after FP received.

I am not sure what you mean by "scanning". Is there a webpage at the USCIS that offers all this information (what url?) or do you manually go through a sequence of case numbers? Can you please explain your procedure?

The fact that nobody from April filers received a reply from FBI regarding their name check status can very well mean that INS never asked for it to begin with - that is why all our cases are pending and have just recent LUDs. So that means there will be additional >3 months of wait time till name checks are complete.

while sending out finger print notices for April filers, VSC had problems sending out duplicate notices. They tried to correct it, and finally stopped sending out notices. That's why many April filers got their first FP in Jan 2004. In this confusion VSC forgot to ask for name checks for some unfortunate April filers.

FBI Name check

Hi Guys,

Sorry if I am asking a stupid question. What is FBI name check? Is this something we need to do right after Finger Print? How do we do this? I appreciate if any of you could give me the details on this.

Here is some info about FBI Name Check. I copied it from somebodies post a long time ago - so I do not claim the authorship. Sorry for not being able to refer to a proper person who composed it.

"Whole security check includes two portions: FBI name check (outside CIS - FBI) and IBIS check (CIS internal). (exclude fp check, as it's so smooth, rarely does anyone have issue with it)

IBIS check has validity of 35 days, FBI name check is one time deal (or valid for a long time).

IBIS takes minutes to finish, FBI name check takes days if you are clean, take couple monthes if there are someone in their database has similar name/background, take years if FBI forget about your case

Before 2002 Oct, CIS officer could go ahead with the adjudication of I485 after waiting FBI for 120 days. After 2002 Oct, case cannot be processed without feedback from FBI.

I-485 is adjudication-ready ONLY after the name check is cleared. (fp check as well, but again it's easy)

Based on FBI testimony, 85% case is done in 72 hours, 99% is done in 120 days.

FBI name check is handled by name check department; it’s not the same department for finger print check. Unlike fingerprint check department, which is smooth and easy, name check department seems to be not as efficient and have issues on the order how they process name checks. Sometimes they simply forget to pick up the request for a long time.

it looks like if CIS doesn’t get name check feedback from FBI after certain amount of time, they will send the request again.


If your local office doesn’t have long line, you could try stop by and ask if your name check is cleared. They have this information. (That’s where I found out my name check was the issue)

If your case is stopped at name check, congressman/senator/AILA can do nothing.

There is no webpage with this information. I wrote a script to automatically gather statistics from a sequence of case numbers.

85 transfers and 6 approvals / card ordered!?... Ouch...

Yes, the transfer rate is unusually high and the approval rate is unusually low. Regarding the low approval rate, I wonder whether USCIS delayed requesting the FBI name check for these cases, and is now waiting for the results.

Has anyone with ND 1 Apr 2003 received a response for a status enquiry? If so, can you please post the contents of the response.
