I got approved today too. It happened so quickly! See my timeline below. I am sure the Writ had something to do with it. I will still hang around on this site, of course, even if I get beaten occasionally by my comrades for merely expressing my opinion. By the way, if you need a good lawyer in DC/VA/MD area, let me know.

Asylum Approved - 1996
Adjustment Application filed - 1997
Application lost by INS - September 2004
Filed Again - April 2005 (looked for a good lawyer)
FP - Sept. 2005
Writ of Mandamus filed with a court in Lincoln, Nebraska - January 2006
RFE ND- February 28
RFE received by USCIS - March 1
Case Approved today - March 3

no thanks no more lawyers from dc/va/md trust me .

This is one more ND05 got approved; my lawyer told me that all ND05 requested to do medical and Bio3 will get approved before one year.

Congradulations! I am happy for you! Do you think the fact that you applied in 1997 helped or do they consider you ND 2005? By the way what's Writ of Mandamus?

By the way, did you get the approval letter in the mail or online/email? I was just surprised to hear you were approved on a Saturday! Enjoy your GC!!

A writ of mandamus is, basic terms, an order from a federal court ordering an agency like the USCIS to do its job.

Thanks waitinglifetime! It's good to hear that, especially when it comes from a lawyer (it tells me it's not just our speculation!) By the way, did he say why/how? Is the cap really removed?

Thanks Thankful! We should all use that then :) (at least people that have been waiting along time!!)

The cap was removed like ten months ago!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

I know you did not ask me :p ,but I want to reply with what I know until he replies to you. I believe the cap is removed because otherwise the ND2005's would not be hearing from INS let alone getting their approvals this early. Until sometime last year it was more in a first come first serve basis which is why the processing dates were listed according to the ND dates ;and since the applicaion numbers were many times more than the approvals allowed per year , that caused accumulation. But now cap being removed and the workload being distributed among service centers made it easier for them to respond to applications with many different ND's. It looks like regardless of what your ND is you are hearing something from INS this past year whether it is them requesting RFI or telling you to get BIO or giving approvals.

I searched and searched the CIS website and I can't find anything that says that. Where did you guys read/find that?

Thanks Clotty :) You have a very valid point. It makes sense, but I wish I could see/find/read something official that says that!

I do, especially after somebody in this forum, I forgot who, said that their LUD changed on a Saturday! I know CIS is not working on the weekend, but you never know maybe their computer/server still updates cases they worked on late Friday :)
 
I check my status online on the weekends too. I sent my RFI only recently so I should not be expecting to hear any sort of approval from them so soon, but I can't help but check; it is like you have a new lottery ticket every day and are checking daily whether you won or not : "damn, not today".
 
Yes, man. Congrats! This damn agency needs a complete overhaul.

My cousin filed Writ of Mandamus in federal district court for his N-400 by himself and he just had his oath ceremony yesterday. As soon as the processing date passes your ND, you should start to act. :)
