Usually all 485 related queries will be sent directly to you. But it is not a bad idea to file for G-28. This will give you the ability to access all your case documents filed to USCIS.

I haven't yet applied EAD and AP ..thinking of applying after 6 months as I am still on H1 ( 7th yr h1 extension is pending and employer has no problems of extending H1s )
If you are pretty secure about your H1B Job, EAD and AP aren't required.

I140 pending, layoff imminent

I have a similar issue. Please help if anyone has a background on this. I concurrently filed 140 and 485 through my current employer. I will be completing my 180 days (after filing 140 & 485) on Feb 5th 2004. But it is possible that I can loose my job before that (maybe sometime in Jan 2004). Please let me know what measures I can take so that if I get laid off, it doesn't jeopardize my GC process ? I have an approved EAD, shall I start looking for a new job and join if I get it ? Since I last entered US on AP, I can't use H1 any more, I'll have to use EAD.

Also what happens if I loose my job before 180 days and my current employer revokes my 140 ? Does it hamper the ongoing GC process ?

I have an approved 140 through my previous employer and I believe it hasn't been revoked. Can I use it in any way for aiding my current processing ?

If u are sure about loosing ur job, u should definitely start looking around. Have a start date of after Feb 5th so that u pass the 180 days test. U can work on a contractor basis till then, if required, and then join on a permanent basis on Feb 5th.

If the employer revokes 140 before 180 days are over, u would be in trouble - ur 485 would be denied. Why do u think ur employer would revoke ur 140? They don't have to do so by law.

---> Technically, u can file 485 based on that as well (without the job letter). However, as u are pretty close to completing 180 days requirement, I would suggest u hang on to ur current processing without complicating ur case with further 485s.

---> Try to convince ur employer of not revoking ur 140 till Feb 5th and then join another job using AC-21.

My 140 thru current employer is still pending.. Can they withdraw the 140 application ? I'll have to find out what their policy is. But what are the options if they withdraw 140 ? I don't think they'll be able to withdraw it before 180 days of 485 pending because they act slow.
