Approved I-140 from ex-employer....change to CP

Hi,

I have previous employer's I-140 with me. It was approved on oct 2001. I left the company and took a permanent job. With my current employer, my LC is pending for nearly 2 yrs. I have lost hope on that LC approval(dates are still showing 4/2001).

I filed for I-485 on my own using the approved I-140 (it is not revoked) in Nov 2003 .
I am working on H1 visa . Can I now change from AOS to CP ? Is it feasible , if yes what forms do I need to fill ?

You can change but your I-485 is based on previous employer I-140 and if you go for CP you will need letter from the employer who filed I-140 and if any problem at time of CP interview or case denied then you cannot appeal. No AC21 for CP. Let your AOS pending

AND maintain H1 status, you are qualified for 7th year H1 extension if hit 6 years then just attach copy of I-485 filing receipt and apply 7th year H1 or 8th year H1

** Keep valid EAD, AP with you for any emergency (EAD if any lay off) and always renew EAD 5-6 months advance of EAD expiry and always keep valid AP.
New company LC pending is also good back up
