APPROVED!!! But permanent or conditional?

I'm ecstatic to find out that I got approved a few days ago. The online status info says that my "permanent" residency has been mailed to my address.

However, I thought you get conditional residency if you've been married for less than 2 years. It has been almost two years now, but not wholly. I read about people getting conditional green cards instead of permanent despite of being married for definitely more than 2 years.

I know I should be glad that it's not the other way around, but could they have made a good (for me anyway, haha) mistake and issued me a permanent one? Is there any chance they can find out in the future and re-issue me a conditional residency?

I think you're getting confused with the email here, they don't send a different email if its a conditional LPR card. You'll most likely get a 2 year card.

If you haven't been married for 2 years when you were approved for AOS the card is conditional. If they sent you a 10 year card it is a mistake, and one that you need to fix. This has happened. If this does happen you need to still file I-751. This mistake would not be "good for you" because USCIS will still expect you to file to remove conditions, even if your green card says otherwise. I've heard of people getting in trouble (read removal proceedings) because USCIS made the mistake of sending them a 10 year card when they should have sent a 2 year card. Make no mistake, if USCIS makes a mistake, it is you that bares the burden of fixing it.

Most likely you'll be getting the 2 year GC in the mail soon.

Thanks for your response, dr_lha!

So I'll be able to to remove the condition on the residency two years from the date I got apporved which will be around spring of 2009, and then I'll be able to apply for the citizenship around spring of 2010, right? I hope it's not 3 years from the issuance of "permanent" residency that you are eligible to apply for citizenship but rather just ANY residency.

Also, do people still get interviewed and have to show (or send in) bills, insurance, lease (in both husband & wife's names), joing taxes, pictures, etc. to remove the condition two years later? I'm so tired of keeping all the bills and stuffs just because of the immigration, lol!

Thanks again!

Oh and one more thing, my employment authorization expired earlier this year, and I forgot to renew it on time, but I did renew it just a couple of months ago. Will I still have to wait for the employment authorization to be able to work in the States, in other words, will I have to go to the biometric appointment next week, or since I got approved, I'm not required to? If not, will I have to call in to cancel the appointment?

Lastly, am I allowed to travel without the advance parole document?

I believe the rule is that you must apply for removal of conditions 90 days before the expiry of your 2 year green card.

I believe the burden of information you have to supply for I-751 is quite heavy, yes. So buy a filing cabinet and don't throw that stuff away just yet!

As soon as you have your green card, that is all the employment authorisation that you need. EAD is just an interim benefit for while you are waiting for your Green Card.
Lastly, am I allowed to travel without the advance parole document?
When you have your green card in your hands, yes. Just like EAD, AP is an interim benefit

Wow, dr_lha, it's you again. Thank you so SO much for your detailed and thorough responses.

So I guess I can just ignore the appointment. No call, no show = no problem? :)

So would it be spring of 2010 that I will be able to apply for my citizenship, or would it be 3 years AFTER I reiceve the "permanent" residency, which is going to be the spring of 2012) that I will be able to apply for the citizenship. (I'm hoping and guessing it's the former since it would be very unfair for those of who received condition green cards because they were approved on the 729th day (2years-1day) of their marriage)

Yeah, I would guess so.

Good news! It will be in 2010, not 2012. Conditional Permenant Residency counts towards citizenship.

Residency since...

Dr_lha,

I don't know whether my question is relevant here. But, anyway, may be you can provide your input... I received my GC with the date of "residency since" indicated as a date of my initial entry to US (several years ago). Can I travel with this GC without any problems? I know that for the citizenship I have to count from the date of approval... But can I travel with this card or should I correct this info before I go abroad? Any inputs will be appreciated.

Thanks,
Z.

Zevs,
If your "Resident since:" date is incorrect, please get it corrected. USCIS will take the incorrect card from you and give you a temporary stamp while they fix the error. The stamp will allow you to travel.
