Will you let us know that u went alone for interview or had a letter by your lawyer or he/she physically was there with you? I'm also AC21 case and 'm eager to know interview details from that prospective. Also if you could which INS office did u go to?

Waited for 4 years for the whole process to complete from start to finish as posted on rupnet site.

In a nutshell, the whole experience was not smooth at all. At every stage, had road blocks.

2 queries for LC, 1 query for 140, 1 RFE, 1 Interview for I-485.

Hope GC stamping and GC card might be easier :)

Obviously relieved of pain of waiting in the dark and uncertianity.


Any idea why your case is transfered? Did you switch to job in CA? Please share since Im in the same situation.

Thanks to all. Even before you asked for it, i wanted to post the interview detaills ealbaorately.

Hope you don't mind if i defer this until i get the passport stamped, so i feel comfortable.

Reasons for my transfer may be: (my take on it)

When asked in previous visit in person, no clear answer was given by IIO.

- Job change coast to coast

- AR11 and VSC address change

(both of these together may have prompted the transfer by VSC, local office may not have bothered that)

This was amply demonstrated by the IIO in the local office when they asked if i requested transfer from VSC!!

Come on, why would any of EB wannable immigrants do that?? that defies logic to me at least.

- Unsatisfactory response to RFE related to showing continued prospect of employment. (such as emloyer tax returns, Annual report and so on, which i could not provide as my company was not willing to provide unless it was a must)

- Length of time passed between LC approval and RFE date
(which may have prompted them to check on current employment)

Hope this provides some ideas.

I may have to relocate (to east coast) within the same company and my salary would be the same and job description would be the same. But I would have to file for address change. Im currently in West Coast and may have to relocate to east coast. Its been 19 months since I filed my 485. So, dont want to delay it further by making this move.
But looks like in your case, you had it approved ahead of the JIT time. You were lucky to have an RFE so early this year, though your ND is Jan 02. So, you didn't lose time, per se. So, I am confused now and dunno If I should accept the relocation or look for something else on west coast ....

And forgot to congratulate you earlier. !!Congratulations!!
 
My I-485 Interview Details: Passport stamped

Folks:

Here is somewhat detailed interview experience posted in text. Same information is in the attached doc as well.

After administering the oath, the officer asked me the following documents by verifying the interview appointment letter. Through out the interview, she was very polite and asking a lot of details.

Driver License, My Tax returns, W2, pay stubs, Employment verification letter, ADIT style photos.

Provided all of them. She asked us to show the original pay stubs.
Further she asked for original SSN cards.
Then asked for birth certificate and asked the information contained in it for verification.

Then asked almost all question you find in I-485 application page 2 such as (not exact, but close to that effect)

Did you involve in any crimes?
Did you use fraudulent documents?
Are you connected with any organizations that are harmful to US?
Have you involved in activities to throw the US government?
Were you ever deported?
Did you marry before? When was it? Show me original certificate.
Have used other names?
Are there any previous I-485 filed?
Last time entered in US?
What was your status when you first entered US?
What company filed for GC?
Did you work for them?
How long did you work for them?
(was not asked when did you start working for new employer?)

Then she moved onto G325A, enquired about parents names and dates of birth.

Asked how long I lived in US? What did I do before?

Asked what was my job before arriving to US.?

Probed into details on what was my job title and job responsibilities.

Then she looked at original LC and asked what is my current salary. Who is my employer?

At this point, my attorney jumped in and clarified that I was working for a different employer and the job is very similar to the one offered in LC.

Then the officer asked to check if they have the same or similar job? Felt that until this time, she was not sure I am using AC21.

Then asked for copies of my EVL and read through the whole letter and asked for employer tax returns. Then she also asked for DE-6 report. Provided them in sealed envelope and she found my name with some effort of looking all the names.

Then she turned to my wife and asked demographic information and asked to show proof of living together. Submitted leasing agreement copies, Joint bank account statements, credit cards and submitted one more copy of marriage certificate, so she can put it in my wife’s case folder.

She verified information in G325A and asked some of the same questions and asked if she was married before. Asked if she have collected any social security benefits or food stamps.

Asked for I-134 affidavit of support and bank statements showing to establish that she can not be a public charge.

Then she took us to a separate room and took finger prints of index finger and mentioned those are for card production. Thought we are done at that point. But to my disappointment, we were guided back to interview room.

Then she continued to ask me to give copies of my I-94, advance paroles, EAD. Then verified originals but gave them back.

She announced that she would need to review the case and asked us to come back at
3 PM to check if she can make a decision.

My lawyer and we said we would wait in the lobby. After lunch, we came back and waited until 3:45PM.

Then we got a call from the officer and informed us that she is approving the cases after the review with her supervisor. But since there is not enough time, she said she will send the approvals by mail.

All the time, the officer was taking notes and verifying her check list and organizing neatly in a folder.

We got it in the mail and got stamped in 15 minutes time on a later visit.

Did u say - u transfered company less than 180 days after filing I-485. Mine is a similar case - please verify !!!!!

If yes, then when hte officer asked you - how long did u work for the original employer - what did u say ???????

Yes you are right. Mentioned how long i worked, which is several years. (do not necessarily from the date of I-485 filing)Also, i have a letter to substantiate that from previous employer.

Did not volunteer any information not asked for.

Not sure if would be the same for all. My take is they asked that to validate the intention and good faith.

Local office is Santa Ana, as someone asked for it earlier.

Yes indeed, i got lucky. But remember, mine was a VSC transfer where approvals came faster than CSC after Oct 01 ND, i guess.

thanks for the info. One last question. After you changed job in 160 days, did you inform INS that you have changed employers?? and did u inform INS about your start date with the new employer ????

Basically i want to find out if it is necessary to inform INS/BCIS of the new employer or just wait with mouth shut till i get an RFE or interview !
