To everyone that can help me,

Im a canadian citizen working as an RN, recently married to USC in the US. I have an offer of employment to work in the US.Im on the process of applying for TN visa before i got married so all my credentials are listed on my maiden name (acctually im not using my husbands name yet) .My husband just sent the I-130 last june but was sent back to him stating that they cant process the application due to some lack of requirements.
My questions are as follows:
1. Im worried that i might be denied because im married to USC, Can I state in my application that im not married? That im still single.
2.Is there any ways that the POE personnel well find out that there was an attemp of processing the I130. that i am married to USC?
4.What will be the best way for me to do.
3.Is there any way I can access to any sample application form for TN visa application.

Im so stress out and anxious of my situation.

I hope someone can help me.

thanks

1. Even crossing the border is problematic for you. Thoise who marry USC's are supposed to either enter on Visa, or stay put in US until they get GC process going. The chnaces of gettinga TN a slim. Do you really want to add a accusation of lying at the border to this mix. You could see your self shut out of US for an extended period.

Seriously.

2. They can ask. They are trained to detect lies.

4. Stay in US, correct whatever problem your I-130 had, resubmit and get EAD.

3. take care of 1,2,4.

thanks Nelsona.
im confused about No.1 that I need to ask a visa because im married to USC. even that Im a Canadian citizen? acctually Ive been in and out USA evey month to visit my husband but I dont have any problem.
2.What are the common questions in obtaining TN visa? Is there any electronic way of tracing my status?
3.how many months it take to apply for EAD, and what are the requirements that I have to prepare.

thanks again

You really need to follow Nelsona's advice. I might add at this point you and your hubby really should be finding out as much information as possible about fixing then re-filing your I-130.
I don't know what questions you get asked crossing into the US but your questions in your first post and your responses afterwards lead me to believe you are not being truthful with your answers and you really do not understand that you cannot enter on a TN as you have "immigrant intent" because you're married to a USC.
Fix the I-130 and stop messing around with the TN application it's only going to get you in hot water at this point.

thanks guys.

since i have slim chances to get my tn... iwill not resigned from my job here in canada, and proceed with making everything right

... and you really need to stop crossing the border until you iron out your US status.

All Canadians enter the US in a status, even if it is B2 tourist status and not documented. All of these statuses, including TN and visitor require no immigrant intent, which you clearly have.

And yes, even Cdn fiancees (k1)and spouses (k3) of US citizens need an actaul visa to enter US.
