Applying GC for siblings

Hello everyone...

I would like to apply GC for my sister and her husband. Now, I am still on the process of getting my US citizenship. Here are my questions...

1. Should I wait until everything goes thru, and then apply for their GC. Or could I apply now and by the time that everything goes thru, I will have my citizenship in hand. Would that work?

2. Once I apply for their GC, can they stay in the country until it comes out? or do they need to leave?

3. Can I apply for a work permit for them as of right now?

4. What is the possibility of them being denied thru the whole process?

answer to the first question, there is no catagory of visa for the siblings of an LPR, so u will have to wait till u r naturalized

1- You'll need to wait until you're a citizen.

2- They cannot stay in the country based on the petition. For them to legally to stay they'll need to be able to qualify for an appropriate visa on their own merit.

3- No, they cannot get an EAD.

In this case, what do you think we should do? I want to keep them here until they can actually get their GC.
What is the possibility of changing their visa status? Or does anyone have any idea on that?

You do realise their GCs will take 12 to 15 years after you become a citizen. You want to keep them here during the 12 to 15 years? They will need to maintain lawful status somehow. The only options will be H-1B and/or L-1. Those will hardly cover the entire 12 to 15 years.

I did not realize that it took that long for this process. In this case, I guess if they stay legally in the country for over 5 yrs they can apply on their own.

In this case I will need another route to keep them here. Those types of visas that you suggested are great, however, I am not sure if they would qualify for that?
Do you have any other ideas?

1) Investor Visa and obtain a gc for the family ???? is that not an option
2) have ur sis and husband go to a school here and once they are done, it wouldnt be hard for them to obtain an H1.
 
Once there is an I-130 in the system, it becomes very difficult to overcome 214(b). Thus in all practicality, H-1B and/or L-1 become the only viable visa choices.

Based on the fact that they do apply for the H-1b or L-1. What is the possibility of them being denied on that? If I have applied for them, would that be a sure thing?

Or can they just apply for a GC with no bases, except they want to move here to America?
Is there a way to speed up the process so they can get their GC faster?

You cannot apply for their H-1B or L-1, unless you own a firm and you employ them in H-1B jobs. If you are asking if your I-130 would cause their H-1B to be denied, the answer is no.

Just because you want to keep them in the US does not make it legally possible. You should them to get an education that would give them the necessary skils to qualify as a guest worker visa. There are rules about hiring your relatives.
