Hi Gurus,

This is about my cousin's case. He is on H1visa and planning to apply for green card (2yrs left out of 6yrs). His wife is from Pharmacy background and trying pass the exam to get the job. She joined him an year ago.

The question is if he apply for greencard now, and if anything happens to his application at the end (if they reject & if his 6yr Hvisa finishes), WHAT ARE HIS OPTIONS OF STAYING HERE? MEANWHILE IF SOMEONE SPONSORS HIS WIFE AND APPLIES FOR GREENCARD, CAN HE JOIN HER IN HER APPLICATION PROCESS?

THANKS FOR YOUR REPLIES.

--- if hie hits 6 years and no LC( the first step of GC) is pending more than 365 days then he has to go back, if his LC is filed now and is pending more than 365 days he can also get 7th year H1 filed, if his I-485(last step of GC) is denied due to any reason then he has to leave US, it all depends what is the reason for denial.

-----YES, when she files her last step of GC (I-485) the spouse can file dervative I-485
THANKS FOR YOUR REPLIES.
