applying for H1 while in school

hi guys,

I missed the Masters H1 quota this year. My OPT ends in Feb. I am planning to join some school to save my status and then apply for H1 next year.

In case I am in school in spring07, and I apply for H1 in april, if my H1 gets processed will I lose my F1 status immediately ? Would I have to leave the country until Oct (visa start date) ?

Please let me know your views ..

No

Unless you have valid status til Oct, you have to leave til then.

So my concern is, after applying for H1 in april and after it is processed, can i still be in school until october and then quit ?

What valid status can i have until oct, other than being registerd in school ?

If you filed change of status, your H1 become valid only after Oct 2007, therefore your F1 status remain valid til Oct(provided you meet all the F1 requirement).

If you are on F1, you must register yourself to school til Oct to maintain legal status.
