Applying for CitizenShip (out side of USA 172 days + 170 days)

I move to USA on 5 th Aug - 2005

I was outside of USA on 13 Oct 2008 to 4 April 2009 = 172 days.

I have to go my home country again & wana spent
Sep 1 2009 to Feb 18 2010 = 170 days with my husband :)

So is that make problem for my citizenship applying?
I wana apply 90 days before 5 years (i.e May 2010)

- How many days i have stay in middle if i travel again in a short time.

- How many days I have to present physically in USA in 5 years for applying citizenship on right time!

- If leave USA on that day (1 Sep 2009) again then will make any problem for me ? If yes then i can changes the date.

- Is there any services center number in New York where i call to get those info for future uses.


Note: I am GC holder, can stay 180 days outside of USA.

Did you maintain a house in the US while you were away and file US income tax ? Although the travel doesn't break continuous residence, you can still be questioned about the trips and asked to provide sufficient evidence of US residency ties for the trips just under 6 months.

There's no hard requirement to stay in US for a set number of days before leaving again, but it's best to stay in US for at least 30-90 days between such longs trips.

You need at least 30 months of physical presence in th US during the last 5 years.
- If leave USA on that day (1 Sep 2009) again then will make any problem for me ? If yes then i can changes the date.
If you leave in September, enough time will have passed between your last long trip to minimize the impact of any residency intent issues.

I am paying $743 this year. I will back on Feb 18, 2010 so I will Fill the New TAX before 15 April 2010

Would you please let me know a Details how Important tax filing for me citizen application.

2 years I was with my father so he paid taxes. now living my self.

2 of the most important documents you will need in your case to show proof of intent to preserve permanant residency is last 5 years of Tax transcripts that you filed as a resident and proof that you owned or rented a house in the US while you were still outside. All the other documents will only help support your case.
 
Finally - I am green card holder. so can i just fill I-130 & G-325 for my husband now ? I am not still citizen. If i fill now is that speed up the process or more slow or no result now?

If its good to apply now then I will apply this moths and go my country for 170 days. After back in few months i can apply for citizenship.

One more thing - I filled I-130 & G-325 myself. Do i need a laywer/attorney? I called to a lawyer who handling my tax. His fee is $200 for this applying. is this ok ? or i will just do my self?

You can either sponsor your husband now or once you become a citizen. Processing time will depend on visa availability, regardless of if you apply as a permanent resident or as a US citizen. The process is straight forward and you can easily apply on your own without having to hire a lawyer.
