Applying for Asylum after 6 yrs residency

Does anyone know if a person is eligible to apply for asylum after residing in the United States for over 6 years LEGALLY. The person I know of had realized that he is homosexual (dont laugh, its serious) and the country that he is from does not approve that and he is being terrorized and abused every time he goes home. Is he eligible to apply? What are the limitations? Any feedback would be helpful as I am trying to help out my friend. Thanks ALL!!

If the applicant has been in the U.S legally, he can apply for asylum, there are no limitations. It is imperative that the applicant hire a good lawyer with plenty of knowledge about this type of cases. It is not impossible to get asylum based on homosexuality, but it is not very easy.

hey guys, thanks a bunch, I spoke with him yesterday and apparently he is meeting with some lawyer this week or so, and I will forward the information about the San Antonio attorney as well. He is worried about this whole new Bush reform about the gay marriage but i believe that has no affect on obtaining a political asylum. Personally, I think he has a legit case as he has evidence of being abused when going back home (from doctors and police reports) and has obvious fear of moving back because of that, plus he has been here legally for so long. But a good lawyer is a must i think. Has anyone heard or known anyone who has gone thru something similar like this situation???
