Applying 7th year extension without completing 6 years of H1b period

HI ALL,

I am working for a software company since 2001.My h1 is going to expire by Oct2003.And my six years period will be over Aug 2004.But attoreny sent me a mail saying that insted of appling extension for 10 months, he can apply for 7 th year extension by showing labor pending more that 365 days.

My questions are

1. If any thing goes wrong with my job, can I use my leftover h1 period.( aroung 1 year).And also should I leave the country, if I loose the job.

2. Can INS accept the 7th year extension without completing 6 years of H1 period.

I dont think your lawyer can apply for 7th year before aug 2004.

1.yes, yes
2. I doubt it- especially if it is more than 60 days before completion of 6th year.
