Apply Green Card to brother and this family.

Hello,

Iam US citizen. I would like to apply Green card to my brother, who is in INDIA. He works in IT field. I know this category is slow in processing. It will take 10 years.
My question is if apply today for Green card. Down the road, he got opertunity to come to USA through H1 or bussiness. What are his chances he will get H1 or B1 bussiness.
Will USA consulate will reject him on basis of intended to stay in USA, as he applied for GC through family based. Since GC is immigrant visa, where as H1/B1 are non immigrant visa.

----Can take 10-12 years many on Forth Preference don't come to US after 1-12 years from India and nobody knows what will be the economic situation of India or US after 10-12 years. only people from Gujarat state in India are still interested in coming to US as most of the relatives of Gujarati people own business in US.

------------------- Once you file I-130 for him then if he goes for H1 visa stamp then he need to provide info on form. He can come to US on H1 as H1 has dual Intent. He will not be able to get Visitor visa for US(because of Immigrant Intent).

-------H1 has Dual Intent but visitor Visa does not have Dual Intent.

A B-1/B-2 visa is not precluded by an I-130 that won't offer an immigrant visa for a decade or more. The B visa is only issued for 10 years and it would expire before an immigrant visa would be available. He wouldn't get it renewed and could have difficulty making an entry as the priority date approached being current.
