Applaying for F1, Brother in US to sponser

Iam really in a fix, knowledgeable ppl please reply

Iam applaying for F1 VISA and joining a top 20 school in my area for Masters(no aid). Ima very ambitious to study in US.

My brother is currently in US on a 3 yr L1 transfer VISA. Me here with my mother who is an house wife. My doubts

MAIN DOUBT : With my brother in US will it create risks of potential immigrant?
If my brother sponsers me even as a secondary salary earning sponser will that risk of immigrant become more??? (since hes helping me)

CASE 1.
I will not name my brother as sponser, will show sufficient funds(full course period) in the form of bank accnts held by me n by my mother. So basically making my house wife mother as sponser.
Will this create any financial instability problem since Iam naming my mother as sponser and showing only liquid bank accnts (ie no salary earning sponser) though funds shown are sufficient.

CASE 2 : Along with sufficient bank accnt statemnts, for more stability I will name my brother as secondary sponser just in case somethin goes wrong. Will this add an advantage of more financial stability? or just showing mother's well funded static bank accnts enough proof of stability ?????

that's fine, as long as their is enough money in the bank.

since your brother is a non-immigrant, naming him as your co-sponsor shouldn't be a problem.

Your brother has L-1 status. He cannot sponsor you for a visa and thus his presence in the US should not harm your cause. Just show that you have the funds needed to pay for you education, you should be ok.

are u sure that my brother cant sponser me because he holds a L1 VISA..?? Can u elaborate on that. how do they regulate that? Where exactly in the process, they will say ur brother cant sponser you?.. during VISA interview??

I have heard many ppl say brother/sister with H1B sponsering younger siblings.
The person above has replied that my brother sponsering has no problem since he is non-immigrant?

one more doubt. Iam here staying only with my house wife mother who has no commitments here(my father has expired) If I also move to US, will our family not become a suspect for potential immigrants?.

I know i need to show that I have strong ties with India to proove Iam not a potential immigrant. In that regard would it be a good thought to lie that my father is alive n retired?.. which cud strengthen claim of the 'ties to India' . My father never held a passport. Anyway they can cross check on that?..I have a lot of respect/love for my deceased father, still i dont want my VISA to be rejected for reasons Iam not entitled for.

A lot of people use the term "sponsor" to depict the fact that they are submitting an I-134 (affidavit of support) for their relatives/friends who are applying for B-2 visas. Your brother can send you an invitation letter and/or an I-134 to support your B-2 application. However, he will not be a "sponsor" for an L-2 visa for you. He can do that for his spouse/kids. Similarly, an H-1B holder can sponsor a spouse/kids for H-4 visas.
I hope you see the difference. The idea is not to get the term right, but its meaning.
You are free to apply for a B-2 visa, independent of the fact that you have a brother in the US on a L-1 visa. For a B-2 visa, you will need to overcome 214(b). Lying is not a good idea. In fact, you will commit perjury if you do that. So don't cover up the fact that your father has passed away. Honestly mention that you have a brother in the US.
One more thing, you need to re-think your statement "I dont want my VISA to be rejected for reasons Iam not entitled for". For any country, only citizens have the right to enter. All non-citizens have to seek that privilege. No country is worth enough to compel one to lie and commit fraud, trust me.

You may only be an ambitious student, but according to US immigration law, you are a potential immigrant until you satisfy the interviewing consul that you are not.
