My fiancee applied for a k1 visa for me and it was approved.i did my medicals and went for the interview, but at the interview point, it was discovered that i had applied for a non-immigrant visa to the u.s with contrasting birth dates and withe the fact that i once used my fiance's surname.

I was then told to apply for a waiver of inadmissibility and also write a letter of hardship.Ignorantly, i applied without evidences of my REAL identity. This took another 6 months before i was granted an appeal to prove my real identity.

This time around, after consulting a lawyer,my fiancee wrote a hardship letter and i had to submit all my foto id's with all credential(all notarised/certified by a lawyer) and all newspaper publication/interviews i granted on national dailies of my country.(All, just to prove my real identity amongst my past applicaions) I had used my real name twice with my real date of birth,my real name once with a different DOB and then my fiance's surname once before my fiance filed for me.My fiancee's parents/sibblings are also U.S citizes and resident there.

My fiance is a U.S citizen now.We dont know how long this appeal is going to take or our chances of being together.
Kindly share your experience.

The embassy says i had used a different DOB when i was applying for a non-immigrant visa.so i had conflicting Dates of Birth, and was given the right of appeal.I have since appealed, with evidences.I want to know how long the appeal takes and how favourable it is or any other suggestions.

As long as the consuluate does not believe you deliberately misrepresented, it should not take more than a few months.

Thanks a lot, Triple Citizen.
I felt a lot better after i got your reply.I had used a different identity(my fiance's surname) and a different DOB in my attempt to get a non-immigrant visa.I was given a waiver for material misrepresentation but i did not submit my hardship letter and evidences of my real identity.

However, after 6 months, i was allowed an appeal. Then, i got a lawyer who guided me through. So i submitted my fiance's hardship letter and mine and all school certificates, foto ID's and all national dailies interviews i had granted in the past,(all notarised) just to convince them about my real identity.I submitted all these in june,2009with a cover note from my attorney. Its actually three months now.I made enquiries and i told my documents have bn sent to the AAO in washington.

I feel better with your answer, but you can still enlighten me if you have other suggestions.Should i still mail them or is my case the worst of all?

Thanks for the reply

Thanks for your reply. Do u have the link to the AAO in washington? Thanks in advance

I know this is going to sound negative and i am sorry for that, however, you should know the US takes very seriously misrepresentation of material facts (names and DOB are the utmost material facts). I, honestly, wouldn't get my hopes too high on the appeals process but you really never know. Also, I think there's generally a 10 year de facto bar before your appeal goes through. I'm curious to know exactly how did you explain why you used someone's else and false DOB.
