Scenario:
I am in I-485 stage. H1B is valid till 2003 and am working on H1B. Haven\'t yet used EAD. Not yet applied for AP. Now if I apply for an AP and before the approval comes I go out of the country. While I am out of US, AP is approved and my friend sends the AP approval letter to me in my home country.

Question:
Can I use AP while entering US? What questions are asked at POE in case of AP?

AP has to be approved while you are still in USA.

AP has to be approved while you are still in USA. There are some links to state dept that tells you clearly about. I suggest do search to find the URL

nsoni where did you find this info?

That AP approval can come while one is out of US?
It is true that AP needs to be applied while you are in US. Also, it needs to be approved before you leave or it is considered as abandoned. Please ...

Here is the info from murthy MURTHYBULLETIN

Effective as of April 1, 2002, the Immigration and Naturalization Service
(INS) changed the form that employment-based applicants receive indicating
advance parole approvals. The change affects the document issued by the INS,
not the form required for filing the request for advance parole. The new
INS-issued form is I-512L (Authorization for Parole of an Alien into the
United States), which replaces the old I-512. The new form contains three
primary security features. First, the form is now on security paper. Second,
the photograph is scanned onto the document. Third, the maceration stamp or
seal will not be on the document.

As regular MURTHYBULLETIN and MurthyDotCom readers are aware, advance parole
is prior permission to reenter the U.S. after foreign travel. Advance parole
has to be filed while in the U.S. and before departing the U.S. It is
available as an option to enable a person to reenter the U.S. in certain
specific instances, most commonly for persons in the I-485, Application for
Adjustment of Status, process. The procedure for requesting advance parole
on Form I-131 remains unchanged.

In order to better assure proper delivery of the I-512L, the Nebraska
Service Center will send the documents to the attorney of record, if one is
mentioned on the G-28 filed in connection with the request for the Advance
Parole. Otherwise, the advance parole will be sent directly to the
applicant. The other INS Service Centers have not yet indicated to whom they
will mail the new Form I-512L.

intrepretation of murthy\'s comments and answer to new..wale

The quote says: AP has to be filed while in US and before departing US. So the scenario described by new..wale might be possible.

If you use AP, fill I94 and present AP, passport and I94 at POE. Sometimes you will be subjected to secondary inspection, but you will receive stamp in all 3.
But if you have a valid H visa stamp in your passport, it is less hassle to use that instead of AP.

No Title

I am planning to apply for AP personally without contacting lawyer. I thought of sending I-131 form only to INS. But you have mentioned other form I-512L inaddition to I-131. Could anybody let me know more details whether I can apply without lawyer and what application forms I need to send with proper documents. Any help will be appreciated.

Form I-131 for AP

Ugadhi, form mentioned here is AP approval form I-512L issued by INS. For AP we just need to file form I-131 with the information such as (A# from I485 receipt) also don\'t forget to include the marriage certificate if applying for your spouse.

More information you can get from www.INS.GOV.
