AP stamp on passport expiring

Hi friends:

Me and my wife entered USA, on June 18th, 2003, using the Advance Parole (AP). The stamp on the passport for AP is going to expire on June 17th, 2004 (that is after one year from the date of stamp).

Currently we both are working on EAD.

Do we need to apply for a new AP to maintain legal status in USA, or just having a pending I-485 application, and a valid EAD are enough to maintain a legal status. I would really appreciate some help on this.

Your pending I-485 alone will keep you in legal status. My wife has no EAD, and her H-4 has expired.

AP not required to maintain legal status

AP is only for travelling outside when 485 is pending. A valid ead is sufficient enough.

Thanks a ton for your input.

AD: who knows????

sharpieterk- as the TheRealCanadian pointed out - you neither need AP nor EAD to maintain status. The only thing you need is pending 485.
EAD lets you do job, AP lets you travel, but status itself is only by pending 485.
