----- if you use AP and are still working with employer who filed your latest H1 then you will be on H1 status, you can also file extension of H1 in future use of AP does not invalidate h1 status.akp158 said:If I use AP to enter in USA. Still I am on H1B ?

but if I do not have stamp in passport (I have h1b approval). still I can enter in USA on AP and on H1B status ? ( I am with same company )

---- you will be on H1 status if you work for the same employer who filed your latest H1 and you did not use EAD and can also file H1 extension in future.
** you can also get H1 visa stamp when you go out and you will getI-94 based on H1 status
