AOS or CP

yep, i've read that but the case is different.
i've got my work visa and back to the states for work.

Not necessarily different. It is still the same as entering the US on a NIV (which is not even a dual-intent visa) with a preconceived intent of filing AOS. Planning to enter the US on a NIV with the mind of filing AOS is a fraudulent misuse of the NIV, an attempt at beating the system.

AOS is for someone who is already in the US on a NIV, and subsequently experiences a change in circumstance.
