AOS or CP? I have questions, cannot decide...

Hello folks,

1) How long does AOS take?

I had notified KCC that I'd be doing an AOS (I am in NYC) but my rank number won't become current until July it looks like. I don't trust the USCIS to adjudicate my wife's and my AOS applications on time before Sep 20 2008.

2) Also, any idea about how many green cards out of the total 50,000 were already actually given out?

3) If I do CP when do I have to send the $375 Department of State DV fee?
 
1.) I wont risk donig AOS that late, because there is a good chance that you are running out of time and have not finished it before Sept., 30.

2.) Nobody knows that

3.) You dont have to send any money they collect the money in the embassy

The more I read about this topic and the more it looks like AOS would be a risky proposition us.

About 2) above: I was told that, the 50,000 DV avail may be exhausted before they get to my rank. We then wouldn't get our residency even if my DV rank is current when we apply. That's scary.


3) So I have *nothing* to pay at all between now and the CP appointment?

4) What's next for us?
I let KCC know I want to switch from AOS to CP
-> KCC notifies the US consulate in my home country
-> when my rank # is current (july 2008), KCC schedules an appointment at the consulate for me (for my wife and I)
-> we fly to my country, do the medical exams ~10 days ahead of the appointment
-> go the appointment, show papers, pay all fees x2 (for my wife and I) there and go through interview
-> approval or denial

Is the process above correct? Have I mixed anything in the order things are supposed to take place? Did I forget anything?

5) What forms do I have to have ready to give them for CP? Do I fill them out right there on that day or do I bring them filled-out in Adobe Acrobat, printed-out and signed?
I read about I-485, I-765, DS-230 and DSP-122 and I am confused about when to use which.

6) I am here in the US on a H-1B and my wife on a H4. Will CP in my home country work for my wife even if she is from a different nationality and if she attends the appointment on the day I go? We would get her a tourist visa so that she can be there with me, do her medical exam at the same time as me and on that appointment day.

that might be a problem. You'd have to find out whether the consulate in your country will conduct her interview. Usually a person must have their interview in the country of their residency.
 
I already did but I read from a CP thread the experience of a British DV2008 winner who said he signed the DS-230 in the consulate at the end of the interview. That's why I am confused.

For yourself, you must send DS-230 Part I+II and DS-122, for your spouse only DS-230 Par I+II. Dont forget to write your case number in the upper right corner of every page.

Are you sure that the fees are $375?
Because it was mentioned in the package that I had I have to pay $775 !!!!!!!!
I think made a mistake by sending it with cashier's check two weeks ago.
I didn 't know that I can pay it after the 2nd NL.
Any advice?????

$375 is just the lottery surcharge! The total cost for CP is $775, for AOS it is quite a lot more (I don't know the exact amount). So are you doing AOS? If yes: I don't know when you have to pay, but if you only paid $775, that's not enough. If you're doing CP: You don't send the money, you pay at the time of the interview at the embassy.

That's exactly, word for word what I have done. But that's for KCC after receiving the notification letter.

What about on the day of the appointment at the consulate? What forms do they want?

Yes that's a number I had seen for the Adjustment of Status (AOS) process,
- DV winner receives Notification Letter.
- DV winner mails back forms DS-122 and DS-230 part I+II to KCC.
- DV winner receives second notification letter to acknowledge reception and say to take it up to USCIS from then on.
- If DV winner has elected AOS then the DV fee of $375 must be paid to the Department of State before KCC can pass on the case to USCIS.
- Then after that, DV winner must do a medical exam (and pay for it ~$150), wait until his/ her DV rank # becomes current and then send all the paperwork to USCIS at their Chicago Lockbox along with more money (USCIS fee, not sure how much).
- After it's blurry and I am not sure what else and when there is anything else to pay.



I didn't know if doing CP meant paying anything to anyone before the appointment at the consulate.

Tazmania, Igmu and JohnKent answered my question:
For CP, I am told there is nothing to pay until the day you go to the consulate for CP. All fees are paid there and fees are paid for each person. So for my wife and I it will be $775 x 2.

Ok, at the consulate you'll need:

* police certificates of all contries you life more than 6 month (except the US)
* military record
* birth certificate
* marriage certificate
*devore certificate (maybe)
* proof of your education
* proof of your financial background
* a picture
* $775*2

So no forms? OK then. I have everything else you mentioned. I guess the hardest part of the DV is winning! :)
