AOS or Consulate under an O1 thats not been used.

Hi there,

I just won the DV 2012 lottery and am now commencing my application.

I currently have an O1 visa but have not utilised it. And am still residing in Sydney Australia.

I read that it's easier to apply for the green card through the consulate rather than doing an AOS in USA. It will take less time that way.

My question is, do I just apply as if i'm not using the O1 currently, or do i have to do an AOS through the consulate?

The O1 is valid until August 2013. However I'm wanting to apply and get all this done ASAP.

WTFF!!!!!!!!! how did you get approved for an 01????? are a movie star? O1-B? or some crazy scientist who won the Nobler price? O1-A?

anyways because your 01 is until 2013, either route would do IF you have a small case number and make it to the interview...but u seem to be the kind that immigration doesn't pay attention to, so I'm sure either routes u will pass by with flying colors.

other than that, my hat to you for the achievement that got you approved for an O1.

although I don't understand why you would say " do i have to do an AOS through the consulate?" when AOS clearly stands for Adjustment Of Status, meaning ur inside the country meaning u don't deal with a consulate inside it's own country.
 
I got an O1 approved as I work in media, and met all the criteria required.
It's my second one, and yes I was blown away as well that I was qualified, even though it had been a long term plan.

The next step was the Green Card which now I'm happy I was selected for the next stage.

My question about "do i have to do an AOS through the consulate?" was meaning, do i have to adjust my status from O1, even though I haven't entered the US under this since it was approved. Or is the O1 that I have totally irrelevant to my case now.

I wasn't sure if I can adjust my status from outside the country as I have a current and valid O1 in my passport.

Oh my case number is 2012OC000005XX
Your case number is low. If you look into last years visa bulletin you interview would have been in November. If you still in Australia at this time I would do consular processing (CP) there. If its clear you are in the US go for AOS, there is no risk at all with such a low case number.

Hey mate, I'm here in LA working with my O-1 since 2010, originally from Sydney... AND just also got won the DV-2012. Sweet!

My case number, like yours, is also in the 500s... no joke! Another thing in common, hilarious!

So yeah, I have the option of an AOS from the U.S or C/P from Sydney. I'm pretty sure to be eligible for an AOS you would have had to have entered the U.S, so C/P would be your best bet at the moment - unless you decide to fly over to the U.S (thereby 'activating' your O-1 status) before you get your Green Card in hand.

C/P is usually quicker and more reliable I've been told by my attorney, plus I want an excuse to head back to Sydney anyway!
