AOS in 3-4 months

Good morning everyone,

This post is just to get a consesus as I will be applying for AOS soon. I have read this and many other immigration forums and noticed that AOS takes around 4-5 months. Is this true? or am i just coming across lucky threads/ forums. I remember in 2004, when my I-130 was being petitioned it was taking 1.5-2 year for AOS to get processed and people used to complain all the time regarding slow process of USCIS. Have USCIS really picked up it's speed that much?

I have also noticed people getting their EADs in 1.5-2 months these days? Is this all true becuase to me it's seems like a deja-vu. In 2004, it was taking long, long time and i guess that's why i am having hard time believe this time-scale.

Please shed your opinion on this? is this really true:eek:
 
yes, in 2004 it took me 14 months to AOS. Nowadays, it takes 4-5 months on average if everything goes smoothly. My EADs took 3 and 1.5 months in 2004 and 2005.

Yes, it took me 3 months and a few days from the day I sent the AOS application to the day of my AOS interview (which was successfull). However, I did send I-130 and I-485 together. If you apply sequentially it takes longer.

well can i send in (I-130 and I-485) together? I already have I-130 approved but my father was a LPR when he filed the petition on my behalf. Now he's a US citizen. We never knew that the dates were moving this fast so we never checked the visa bulletin. Just by coincidence, we checked the bulletin and realized that our petition may be current under IR-1 category, rather than F2B category. We didn't have time to upgrade the petition?

Can i just file I-485 now, along with I-130? I read some posts that i can, but i just want to be sure from you guys as I don't want USCIS to deny my 485
 
gc200, my case was marriage-based GC, so I am really not familiar with the immigration process that applies to you. Also, the timeline above is typical for marriage-based. Again, I am not sure if it applies to your case, since the processing might be done at a different location.
 
well after research, i have figured out that my application will also be sent to chicago lockbox, but from there onwards, i don't know where it will go.

But thanks for replying though. Anyone out there can you please advise something.
 
Once you applied, you will be able to tell where the aplication was sent by the first 3 letters of your receipt number. Dor example MCS stands for Missouri Service Center.

That doesn't make sense. If your parent is the petitioner, F2B is for their children over 21, whereas IR1 is for children under 21. So you can't move from F2B to IR1.

You must mean the FB1 category, for unmarried over-21 children of citizens. Not IR1.

Are you inside the US legally? If not, you're not eligible to file for AOS as F2B or FB1.

ok I am sorry. I have used those terms before and somebody corrected me to say that I woud adjust from F2B to IR-2. I guess I misunderstood

Anyway, my father filed a petition as a LPR for unmarried, over 21 years old son in 2004. Now the father is US citizen and the son is still unmarried and over 21.

So please correct me if i am wrong. I was in F2B category (son of LPR, unmarried and over 21) before and now I will be upgraded to FB1 (son of US Citizen, unmarried and over 21). Is this correct?
 
so Jack, just for confirmation: can I submit I-485 now with my I-130 approved notice or not?

Would CIS question my eligibility for I-485?
 
If your priority date is current for FB1 (remember that the latest visa bulletin takes effect in June, not right now), you can go ahead and submit the I-485 with the I-130 approval. But you'll have to include all the other necessary documents that are associated with the I-485, like the I-864 (with your father's tax transcripts) and I-693 medical and a copy of your father's naturalization certificate. Those may take days or weeks to gather and complete, so if you haven't already prepared everything you won't be able to submit the I-485 right now.

I got all the paperwork ready over this weekend. I visited the civil surgeon today and should have that paperwork by Wednesday....THanks for all your help again.
 
Quick question regarding stapling the files and documents? I read on USCIS website that you can staple the check to I-485 application, but it doesn't mention anything about stapling the application itself.

I-485 is composed of 6 pages, I-864EZ contains 5 pages.... Can we staple those or Immigration officers don't like that. How did you guys send your application.

Can we use ACCO folders?
