AOS and travel

Hi,

I'm under J1 visa and I applied for AOS (based on a pending I-140) and I wonder if I can travel abroad with my J or I need to wait for my AP before traveling.

No you can not. Only H and L can use their visa to travel. You have to have AP first or, no AOS and no AP will be issued or mailed overseas and all that.

Moreover, since you can only return with an AP document, you cannot regain J status when you come back, by definition. So make sure you have an EAD so that you can continue working upon your return. I assume you were not subject to the 2-year home residency requirement or got a waiver before sending your I-485.

Thanks mmed and jk0274. I've a waiver for 2-yr home residence requirement and I sent a copy of the approval notice with my I-485 application. I hope to get my AP and EAD soon (and the approval of my I-140!).
