After receiving my GC do I have to wait till citizenship in order to apply for my wife who's already here with me ? Or I can apply for her status adjustment right after receiving my GC? If so than while her case will be pending can she apply for a driver's license or work permit? By the way I got married 3 years after I granted asylum. If anyone has any experience could you please share that with me? Any response would be highly appreciated.

That would depend on her status. If she has been here illegally, then it will be tough, I'd get an attorney. My mom got asylum, and then my dad joined us here. He came on a tourist visa and got derivative asylum from her. Look into derivative asylum, especially if she's from the same country as you.

what is the status of your wife? Was she included as your spouse with original asylum application. You must have already told CIS about your marriage, if that occured after applying for I-485. She must be legally present in the US for you to apply for her after receiving your GC. Yes you can apply but quite frankly it can take 3 years before a visa # would be available to her. If she cannot maintain legal status in the US, then send her back to her home country and apply through US Embassy.

You can apply, but it takes about 5 to 6 years. No she cannot stay here legally until the process is complete. Sorry.

My wife is a permanent resident in Canada but not citizen. She came to States 2002 for visit purpose & we got married. As a Canadian permanent resident she never needed no visa to get in to USA at that time. Now her status is she never went back to Canada. I was kind of scared sending her back thinking if she has trouble coming back to USA after 9-11 issue had made this so tough now a days. I applied my status adjustment (I-485) in year 2000 long before I got married & was granted asylum in 1999 way before all this. Therefore she was not in my asylum application. Now what's my option. No I never notified USCIS about the marriage.

Your wife would be canadian citizen long time ago. It's a waste! Apply for her right away when you get your GC.You may get her visa number by the time you become US citizen and you would save time.Since she didn't get visa/I-94 number when entering US,she gonna need definitely to go back home once her petition is approved and then reenter US with visa.Meanwhile, she's not gonna be able to get a work authorization or any other papers until she gets on the right track.

Be aware of the possible application of the 10 yr reentry bar.

Atique! My brotherly advice is talk to attorney. Canadians are allowed to stay in the US for 90 days without a visa. A canadian can be as illegal in the US as an indvidual from Somalia. As "thankful" mentioned that there can be ban for 10 years on her. So seek an attorney.
good luck.

atique,
if by any way your wife's status is leagal in US, you have to apply immigration visa for her. usually you got approved quickly. but you've got to wait for a visa number for the case. the normal wait is 5 years now. but by that time, you've already got the citizenship. for us citizen, you don't have to wait for a number. either way it's very painful long period.

may I suggest that you ask about student visa requirment.
I think you wife with canadien P.R. she have big chance to get that kind visa.
that way she can stay with you..and if she study nursing then she gonna be able to get her u.s. P.R. faster than you think.
