Any idea what is going on in VSC?

Recd an email from one of my friends with following 140 cases(not sure if it contains all for the day, but numbers looks like it is close to 100% if not 100%).

I have not verified all of them, but did verify some of those which are approved! Now any idea?

Speculations welcome.

It is close to 30% approval (28.36%), which is much higher than nurse or special quota. It is close to figure where USCIS changes processing dates, when compared to approval % on immigrationwatch.com.

Has April 01, 2004 something to do with this processing? (FO memo comes in effect?)

I think what's happening is that USCIS is trying to reduce the backlog for I140 to 2-3 months like it used to be and maybe, I hope, they will focus finally on I485 to do the same ... just a guess. The fact that are approvals in March-Apr 2004 can mean that they are pulling folders from the stack randomly knowing that they have to finish all of them sometimes ... until Aug-Sept maybe.
 
Though I agree that recently they are doing better job, but I am not so optimistic. There were 18 approvals out of 66 cases, and I do not see any big deal here, as in June 4th published dates from CIS, the current date for Nurse’s 140 is Apr 19th, and therefore most of these Apr 12th cases can be from that category. The update of other 47 RECEIVED status cases can be an error, as some one pulled out all the cases for that day.
 
I am not sure either. But I have never seen special cases 30% in number! I agree I have seen close to 18-20% at times(rare but yes it has happened and maybe 1-2% being lucky ones.). This is a huge gap. Did all nurses decide to apply on this particular day?
 
I'm not sure these numbers mean much...?

These could easily be due to a combination of:

+cases which were approved quickly due to the catagory (nurses etc.)
+cases which generated an RFE, RFE received, case approved shortly thereafter

I've often seen some % of early approvals for just about any date that I've checked.

e.g. 10/01/03 has had a bunch of cases approved ever since I started looking at that date, some from quite a while back:

ETA - if you see closely it is just 2 cases which are approved fast(2 months) out of maybe 20-25 cases?

It is 10% and close to reasonable figure of Nurse quota. What I am trying to say is that 30% is way too high.

First set has mid April 2004 cases(after FO memo) and second set has mid to late March 2004 cases(before FO memo).

Did something happen for mid April cases? Is it continuing for other dates too? I feel nemessis has a point here.

Here is my guess.

I think some percentages of apps should be approved or acted upon inorder for USCIS to post it as official processing date (bi weekly report). so i think they want to get the current processing Date as close as possible to Current date or one or two months behind by begininng of the Fiscal year 05 which starts in OCt 04. (US govt fiscal year is Oct1 to following Sep 30th).
The will need to allocate more resources for new H1b's starting from OCt 01 04 for which i don't think they are hiring ( as a matter of fact there is Hiring freeze last i heard unless it is removed now) new employess. so the resources (ppl/IO) has to be allocated from existing Resources.

so what is the reason for approving certain range apps with certain Receipt Nos which is not in chronological (logical order)??

I think this could be that certain officers were assigned to clear these backlogs(I140s) and they will just pull the apps with certain Range of Receipt Nos from the shelf (or from middle of the earth) and start acting on them. remeber USCIS receives atlaest 4000 to 5000 apps(all kinds) every day (average).

so then why the discrepancy in between certain range of apps if look at the first post of Jharkandi there are approvals for alternative RN and then at the middle there are approvals for 4 straight RN's and then some alternative approvals.

This could be that the apps which are not acted upon were not clearly understood by Immigration officer (IO) and he need further advice/guidance for that . For the apps which he thinks are straight (more like he/she understand it) then he will approve it or send an RFE. The explanation for this could be change in the last updated date on Website but no action on App.

one of my collegue from my company(ND Aug 15 03) got an RFE asking for experince letter from the company he worked for from 1997 to 1999.They wanted it as of today which means the letter should have recent date . That company no longer exists so how is he gonna a get that??

the point is it depends on the IO and how he/she interpets the law and memos. I am sure CIS has docs/checklist for IO's for further explanation of memos/Laws (in plain english). so i think part of the process depends on IO and part when will your app will get pulled or acted upon.

I think most if not all get pulled, the question is when will IO will decide to act upon it based on his understanding of the case (app) and laws/memos

Remember even though most of the ppl on this forum are pretty much straight forward cases EB GC is 5 types. so if you include EB1 ,O1,EB2 Niw, EB2, EB4, EB5 the IO has to act upon it based on the category.

I personally think EB3 is easiest for IO provided it is not labor sub and all the documents are submitted before hand ( one of the reasons why i went for EB3 even though i could have gone for EB2).

Not IOs' are same and may not have same level of understanding of laws and cases.

Does not look like all case to me. The range is only b/w 52000 and 53999. I have scanned 1000 140 cases with my RD (i.e. March 22, 2004) and there are about 30 cases in 50001 to 51000

Could you post your series please and approvals of same? Can you plz scan 50001 to 51000 for Eac04141 ...? :) I do not have Excel.
 
I see one more pont in the cases of mid April 2004.(First one). They have been processed on three dates: 5/20/2004, 5/25/2004 and 6/3/2004 + 6/4/2004, which are a week apart. It is not same as that for nurses that we have seen in past. Those cases were done on one day only. nemessis do you have data about Feb-Mar 2004 (Pre FO memo) and April-May 2004 (post FO memo) for 140?

Same ND as the first one. Anyone doing scan for April 01, 2004 and later cases - please report your outcome. This particular date is 30% done when you add approvals and RFEs! This is fourth round of approvals for this date(once every week for last 4 weeks).

NSC is much smaller than VSC- cases are less too - so mobilizing as per FO memo is easier for them. I would not be surprised to see first concurrent approval coming from NSC.

NSC has done good with FPs and 140 time on notice is least for it - I read someone reported 150-180 days for 140 approval time on notice, which is very good. It looks no approvals coming in NSC currently - it is a definite sign of change. The same thing happened in VSC too till last update. After that we saw reasonable number of approvals. But in VSC too there is no concurrent approvals as such - perhaps they are still undergoing changes.

Once changes are in place, NSC will move at a very good speed, esp with FPs done and internal changes starting in April itself - it is best equipped for changes. Allow till middle of July before making opinion.
