Any EB2 Approvals lately?

HEY..
I GOT APPROVED!!!!!!!!

got the emails yesterday... they actually managed to approve my case before
the fingerprints expired today...
Wife's case is still hanging. We called NSC... they said approvals are still happening...

I expect that all the people in the EB2 category will get approvals very soon.

Yeah its been a long time in coming.. To think about it this is my 9th year in the states.

but in case it helps anyone.. more details on my case.

Mar 2004-- Applied for Labor
Oct 2004-- Labor approved. Company informed me in December after I started calling them 5 times a day. :)
Jan, 2005 -- Filed 140,485
140 approved in May 2005, but company of course hid that info too... they knew I would apply AC-21 and leave as soon as I could.

Left company in July2006... company withdrew I140.. I filed AC-21. Got RFE on my I-485 in Oct 2006 stating that pending 140 has been withdrawn and 485 will be denied, unless evidence is presented to the contrary

Unfortunately Also had to file renewals for EAD and A/P around same time, in OCt 2006. They got denied, erroneously by USCIS.
Filed MTR for EAD. Contacted AILA liason in NSC. USCIS admitted error and issued EAD.... but not Advanced Parole. Go figure. So got EAD in Feb 2007, just a few days before my current EAD would have expired.

Reapplied for advanced parole last month. It was cheaper than paying for another MTR and lawyers fee again. bloody lawyers.

No status updates on I485 after receipt of RFE, till the approval yesterday.

At present just waiting and hoping for approval on my wife's case.

So its been one big long expensive mess all along. And half the problems were caused by USCIS not being aware of its own rules and regulations. Infopass is absolutely useless. It was only good for getting interim EAD's, and now its worthless except for getting emergency advance parole. Cust svc reps don't know anything. They may as well shut that down and staff more people in the service centers.

its been a long rant.....:)

Congrats airberd

Hey airberd,

Great to know about your approval...congratulations. And good luck for your wife's pending app.
Hope that this triggers off activity on the other pending Eb2 cases at NSC.

BTW...with the dates retrogressing 'only' to Apr 2004 for Eb2 India in the Sep visa bulletin, any thoughts on what they might be for the Oct bulletin?

Best wishes,
Prats

Congrats!!

Hey airberd...finally you got it!! :D Wonderful news for EB2 fellows...
Congrats man!! Good luck, have fun and keep us in your prayers!...We will try to keep this thread (that you started) alive...Thanks!

Prats,
I was a little skeptical of the rumors floating about EB2 dates going back to Jan,2003. Didn't make sense. esp since there are not many EB2 cases in the backlog centers, and we have seen so many approvals in the last 3 months for 2002,2003 and now 2004 priority as well. My opinion, it should remain at apr 2004. PERM and the whole BEC mess started after Apr 2004, so that will hold up things for a while. But then again, according to Murthy and Shusterman, there are not many EB2 cases stuck in BEC anymore. Most have been certified and I assume have filed 485 by now. So this Date for the Sep Bulletin should already reflect all the cases that are pending.

But then again, uscis moves in mysterious ways.

plus lets not forget that most of the cases pending now with USCIS filed prior to 2005 have visa numbers assigned to them, thats why people are getting approvals inspite of an official unavailibility of visa numbers.

and finally, if someone with a luck like mine can get an approval, you guys cannot be far behind...:)

Actually, They were not exactly rumors floating around. They were opinions from Murthy and Shusterman citing some unknown sources from USCIS.
So of course, the dates might still go back to 2003. These guys usually have a good source for their information.

I don't see any EB2 case older than mine now. Just got a letter (thanks First Lady) from FBI saying my NC is still in process (as of 7/26/07).

I am on my way to apply my 5th EAD now and the fee almost doubled.

I agree with this theory: FBI knows I am not a security concern, so they just let my NC sitting untouched. What a f***!

hyyz, How does April 2001 sound to you ?.

epidural,

Your PD is older than mine. But since your 485 ND is 5/07, there is a big chance that your NC is not cleared yet and CIS/FBI doesn't think it is old enough.

For me, NC has been pending 43 months. And I have just finished celebrating my 10-year anniversary of stay (LEGALLY) in this country:eek: .

hyyz,
If i had not been stuck in the black hole called PBEC i should have been in the citizenship line. It got cleared this year Feb, 58 months and could not do any sh**t about it. Anyways nothing to brag about i guess, just to make a point as some one has quoted "Nobody dies virgin, life screws us all":) . I guess atleast we both can substitute life with immigration. Hope we both and all those similar to us get our cards next month when the PD's become current.

saw this-------....
Just an indication that they are processing applications with receipt dates in early 2005 now. Mine was Jan 2005. This one is Mar 2005.

Just wanted to thank the forum for all their help and information. Although i have not contributed at all until now, this forum has helped me over the years to keep track and answer a lot of questions.

Out of my experience, I can just say, be patient with the process and it will come through successful eventually (although i have gotten frustated a number of times these 5 years), just hold on. Prayers helped me!!:)

Thank you all and Good Luck to you too and hope and pray all of you get your GC's soon.

Hello Folks

Hello Folks,

I am new to this forum and wanted to say hello to everyone. As you can see that I have a PD of Sep '02 and was stuck in PBEC. I see a few old-timers from PBEC here. The wait in PBEC de-senistised me so badly that I have no idea now what's involved in 485 stage. My 485 was filed in Feb '07. Does anyone know what threads I should read to upgrade my general knowledge? Also, around what dates are they working for 485 (excluding name-check) or is it random as always?

2002calobor.. you can call up NSC and ask for the status of your case. it may not amount to much since your receipt date is feb 2007, and all your checks may not have been cleared(FBI, security, other imaginary items like namechecks) but it never hurts to get a status update.

You can also initiate a service enquiry cause even in september bulletin your case is current.

Once you get your status, then your next course of action can be decided.

basically, if you are stuck in namecheck, then write letters to everyone of importance and their families, including the hopeless texans in the white house.
Otherwise, its a wait and watch.

hope this helps.
and with 217 posts, i wouldn't say i am new to the forum. :)

airbed,
Thanks for the info. When I said new to the forum I meant new to 485 forums :D Jeez, 217 posts, I have started greying looking at these forums.

So anyone has experience with calling NSC for status updated? Do they respond with the info or is it just mostly boilerplate responses?

Also, can someone give me a general outline of 485 process i.e. if you are not stuck in name-check do they call you for an interview? or do they sometimes waive it? What happens at the interview? What kind of questions? Also, what documents do they ask you to bring? What traps to expect when they call you for an interview? If you do pass the interview do they place a stamp in passport there and then or do you need to mail the passports? From that point how long does it take to get the physical card?

Any info will be helpful, I am "new to 485" and completely clueless about it.
