Hello,

Have there been any such cases where it has been more than 10 months and I-140 has'nt been approved yet? If so then please kindly share your info in this thread. My I-140 was filed back in March 2005 and I am still waiting for the approval. If there are other people who are in the same boat than please share your info.

Here is my status.

EB2 Original labor (not substituted)

I140 filed on 13-12-2004
RFE on 03-01-2005
RFE responded and recd by the office on 04-06-2005.

My attorney wrongly chose the category as EB3, while my Labor was approved on EB2.

Immigration asked for Educational Evaluation with out my experience to decide my category.

Contacted immigration couple of times and they always respond as actively working on my case.

Mean while there were 4 updates in the date and no message is altered.
UPDs were on 02/07, 02/13, 02/15 and 02/28.

Total suspense. God only can help.

I to got LUD changes on my I-140(applied on 07/28/05) on 2/10, 2/25.
But no status message change.
Waiting for I-140 for last 8 months????

My lawyer did the same mistake.On 8th jan he got a letter from VSC saying my I-140 case is now changed to EB-2 category that time I got 2 lud's No updates after that.

Did VSC send a letter saying your category was changed to EB-2 on their
own ? or did they change it after your lawyer requested it to be corrected ?

EB category change

VSC questioned why the application was filed on EB3 while it should be EB2 based on the Labor.

Hence, mu attorney woke up and found the mistake and rectified it.

He also admiited the mistake in his covering note.

Attorney's mistakes costs our life badly

I think i m one of the oldest in ths form for my eb-3 I-140 Pending. Since Jun 2003.
Latest reply I got from USCIS is
"The processing of your petition/application has been delayed. We are awaiting further information from another office to assist us in the final adjudication of this case. As soon as this information is received, processing will continue on this case.”
Don't know wht this means.. Only miracle can help me. from USCIS.

My I-140 has been approved finally on March 16th 2006. My 9th year extension has also been approved.

labor prioity date - 03/04 (NH state) EB2 category
I140- ND 07/28/05, LUD 02/05/06, RFE 03/08/06 after 8 months of ND
I485- ND 07/28/05 AD-??

Waiting for my I-140 approval??????
