140 Status primafacia
I called the IIO today for the status of my 140. IIO told me that the application is pending and the first question asked was if i applied 485. When i told yes i did but only subsequently and not along with the 140, she said thats what is holding back ur application as there is a need for prima facia needs to be done. She also said that "You need to have patience sir!!!" I am not sure if that would be like an year or 2!!!!
If this is correct, what i make out is
1. Even though EAD and AP are approved there is nothing done to the 140 application i.e. no primafacia.
2. If applying for 485 is delaying the 140 application then why is that CP applications are also getting delayed?
These are the questions for which i guess there are no answers. I did not wanted to take any more time of IIO so i did not ask.
Any comments???

myra12...we should be in touch via the forum since we are in the same boat. Are you doing AC I-140 or the regular CP? what consulate in India?...Also let me know if you have had any progress since I-140 approval? Coz many of the folks in this section of the forum would be with us in CP and would like to know next steps!

i'm doing the regular CP since i don't know if my consulate (Manila) accepts AC I-140.
my I-140 was approved on March 12, 2003 (ND:7/13/02, CP option, EB3). unfortunately, when my lawyer received the approval notice on March 18, he noticed that VSC made a mistake as they did not indicate that my application is proceeding through consular processing. i don't know the exact language in the letter as my lawyer didn't send me a copy. my lawyer called them up and VSC agreed to make the change as the mistake was on their end. i checked my case status online and it looks like they sent another approval notice on april 2. i'll try calling NVC next week to check if they finally received my file.
my PD is 4/26/01. i'm just hoping that the whole process won't stretch out to 3 years!!!

From that i understand that she meant 485 is holding back 140 in my case as prima facia needs to be done on 485.
Which does not make any sense.
