am i out of status

dear all,i needed your expert opinion on my H1 status.i had H1 appoved in oct 05,i was in india at that time,i entered us on H1 in mid nov.i joined work in mid feb06 and that is the glitch.also i am not working since may .now on talking to lawyer i am told that i am out of status,best bet would be to return to india/any country and get new I94(within 180 days,meaning before june)and then join work.
my question
-should i leave the country and come back on new I94 gor can the delay in joining can be attributed to family reasons or something else

-if i leave the country would it solve the problem

-i am currently not working i would start in aug 06.can i account this time to family leave,emloyer willing or should i start work asap

The reason for not working for your employer is not clear.

Start Working with your sponser 15 Feb 2006
Stop working 30 Apr 2006
Not working 1 May to present

If the situztion continues, what is the purpose you are staying with your sponser?
This situation going back to home country will not help you.
If you are here other than working and making money, we do not have any suggstion at this point of time

thanks great guru for the reply.i have a 15 mth old baby who is anaphylactic to milk and allergic to lot of other stuff.i could not work because i was having problem finding day care/baby sitter.the time i found somone i worked rest was not working out but i would have family coming in aug and i would be able to work.so now i stll am able to go out for couple of hrs but not full time.that is the reason for delay.

-------------- in your first post you did not write that you gave birth to baby. read FMLA and you may be covred.did not your lawyer told you about FLMA??
 
also it does not apply to me when i read it because i have consumed more than 12 wks of vacation and to be eligible you should have worked for 1 year.
