Am I in legal status?

Here is my situation...

Company A filed my H1 in Sep, 2002 when I got laid off from previous company and we received H1 approval with I-94 extension until March, 2004.

After one month I started new job with Company B. By this time I haven't recieved Company A's H1 approval. So based on my previous company documents Company B applied for H1 in Oct, 2002. Later my Previous company Visa stamp and I-94 expired in Jan, 2003. This H1 process took so long and recently(this month) we recieved H1 approval from BCIS without I-94 attached to it. I am still working with Company B. My Employer says, I need to travel to my home country to get current visa stamp stamp as well as to get new I-94.

My question is, Am I in legal status? (Based on company A's I-94 date). Does any body suggest me what would be the best way to deal this sitauation. Thanks
 
If your latest H1B notice did not have i94 attached and your
i94 card (the one you got at poe) is expired then you need to leave usa immediately to get it stamped .

you have been out of status from the h1 approval day. You can go to the nearest border and get a new I94 too. It has worked for many -if the out of status days are not more than 30 days...
